A SUMMARY OF HOUSE BILLS 5447 AND 5448 AS INTRODUCED 11-01-02
House Bill 5447 would amend the Michigan Penal Code (MCL 750.317a) to increase the penalty for manufacturing or distributing a controlled substance in violation of Section 7401 of the Public Health Code (MCL 333.7401) if that controlled substance caused the death of another person. Under the bill, the person committing the offense would be guilty of a felony punishable by imprisonment for life or any term of years but not less than 20 years. The bill would not apply to someone who was prosecuted under the penal code for first-degree murder.
The bill would take effect 90 days after it was enacted.
House Bill 5448 would amend the Code of Criminal Procedure (MCL 777.16p) to specify that manufacturing or distributing a controlled substance causing death would be a Class A felony against a person with a maximum term of imprisonment of life.
