A SUMMARY OF HOUSE BILL 5803 AS INTRODUCED 3-14-02

Under the Michigan Vehicle Code, a vehicle dealer selling or assigning a vehicle to a vehicle scrap metal processor is required to make a record in triplicate on a special form devised by the secretary of state following specifications in the code. (The form is known as a scrap vehicle inventory form, or TR-9, and the processor obtains this form rather than having to obtain title to each vehicle delivered.) One copy is retained as a permanent record by the dealer, one is retained by the scrap metal processor, and one is forwarded to the secretary of state. House Bill 5803 would amend the code to specify that:

·  a dealer selling or assigning a vehicle to a scrap metal processor would fill out the special form in triplicate only if the vehicle was flattened, baled, cubed, or crushed, or so damaged that its identity could not be determined; and

·  a dealer selling or assigning a vehicle whose identity could be determined would have to assign the vehicle's certificate of title to the vehicle scrap metal processor.

The bill would also delete obsolete language from the code.
