A SUMMARY OF HOUSE BILL 5943 AS INTRODUCED 4-23-02

House Bill 5943 would amend the Metropolitan Transportation Authorities Act to allow a city to withdraw from a regional transportation authority under certain circumstances.

Currently under the law, one or more contiguous counties can establish regional transportation authorities in major metropolitan areas of the state. A county that becomes part of an authority can withdraw within one year of joining, if its county board approves a resolution to do so by a majority vote of the members elected and serving. In addition, a county can withdraw after one year of joining, if a resolution to withdraw is approved by two-thirds of the county commission members elected and serving. However, if the county has an elected county executive, he or she can veto the resolution to withdraw, although a veto can be overridden by a two-thirds vote of the county commissioners.

House Bill 5943 would retain these provisions and also specify that a city with a population between 100,000 and 150,000 people that is located in a county that has become a part of an authority could withdraw from the authority at any time. To do so, the city council would be required to adopt a city council resolution by majority vote. Finally, the bill specifies that a city that withdrew from an authority would have no further direct or indirect tax liability to the authority.
