A SUMMARY OF HOUSE BILL 6161 AS INTRODUCED 6-4-02

House Bill 6161 would amend the Public Health Code (MCL 333.2690) to prohibit persons from knowingly selling, transferring, distributing, or giving away fetal tissue for a use prohibited by the code. In addition, the bill would prohibit persons from collecting fees for obtaining, processing, transferring, or distributing an embryo, fetus, fetal tissue, or neonate whose use violates other provisions of the code. A violation of these provisions would be a felony punishable for up to five years in prison.

Part 26 of the health code regulates the collection, use, and performance of health-related data, information, and research. The code currently regulates the use of embryos, fetuses, and neonates for research purposes and specifically prohibits persons from knowingly selling, transferring, distributing, or giving away an embryo, fetus, or neonate for a use that violates the code.
