A SUMMARY OF HOUSE BILL 6172 AS INTRODUCED 6-5-02

Under the Crime Victim's Rights Act (MCL 780.752 et al.), crime victims have the right to make an oral impact statement at the sentencing of defendants, including trials involving juvenile defendants. House Bill 6172 would extend this provision to also permit certain neighborhood associations to make oral impact statements at defendants' sentencing, including the sentencing or disposition of juvenile defendants. Specifically, the bill would specify that any member of a neighborhood association whose boundaries included the victim's residence could appear on behalf of the neighborhood association and make an oral impact statement at the defendant's sentencing. The bill would define "neighborhood association" to mean either of the following:

·              A neighborhood organization, as that term is defined in Section 5 of the Neighborhood Assistance and Participation Act (MCL 125.805). ("Neighborhood organization" is defined under that act as "any nongovernmental organization serving an area with geographically definable boundaries, having elected officials, adopted bylaws, and a minimum membership of 50 households, or 10 percent of the households, within its boundaries.")

·              A nongovernmental association or organization that served an area with geographically definable boundaries and that had as its primary purpose the reduction of crime in that area.
