FOIA: DHAL RULES - H.B. 4952 (H-1): FLOOR ANALYSIS

House Bill 4952 (Substitute H-1 as reported with amendment)

Sponsor: Representative James Koetje

House Committee: Commerce

Senate Committee: Government Operations

CONTENT

The bill would amend the Freedom of Information Act to allow the Department of History, Arts, and Libraries (DHAL), instead of the Secretary of State, to promulgate rules providing for the disclosure of the location of archaeological sites for purposes relating to the preservation or scientific examination of sites. Under the Act, a public body may exempt from disclosure information that would reveal the exact location of archaeological sites, and the Secretary of State may promulgate rules for the disclosure of the location of archaeological sites.

The bill would take effect August 6, 2001, and is tie-barred to House Bill 4941, which would create the DHAL.
