FRIEND OF THE COURT CASES - H.B. 6012 (S-1): FLOOR ANALYSIS

House Bill 6012 (Substitute S-1 as reported)

Sponsor: Representative Bruce Patterson

House Committee: Family and Children Services

Senate Committee: Families, Mental Health and Human Services

CONTENT

The bill would amend the Support and Parenting Time Enforcement Act to specify that, in a domestic relations matter in which the court ordered a Friend of the Court (FOC) case not to be opened or to be closed (as provided in House Bill 6011), if an FOC case later had to be opened or reopened, the court would have to issue an order containing provisions required under the Act for an FOC case.

In addition, an order of income withholding in an ex parte interim support order would take effect after the expiration of 21 days after the order had been served on the opposite party unless he or she filed a written object to the interim order during that 21-day period. Currently, the order takes effect after 14 days unless the opposing party files a written objection within the 14-day period.

The bill is tie-barred to House Bill 6004, which would amend the Act to require that support orders be stated in monthly amounts and to address liens against a delinquent support payer's financial assets.
