HOUSE BILL No. 4319 February 21, 2001, Introduced by Reps. Gieleghem, Woodward, Spade, Waters, Kolb, Bogardus, Lipsey, Schauer, Bovin, Basham, Sheltrown, Hansen, Pestka, Jamnick, Bernero, Rivet, Lockwood and Lemmons and referred to the Committee on Criminal Justice. A bill to create a state community policing assistance pro- gram; to prescribe certain powers and duties of certain state departments and officials; to create a fund in the department of treasury; and to provide for an appropriation. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "community policing assistance act". 3 Sec. 2. As used in this act: 4 (a) "Department" means the department of treasury. 5 (b) "Fiscal year" means the state fiscal year. 6 (c) "Fund" means the community policing program fund created 7 in section 6. 8 (d) "Grant funds" means the funds awarded to a local 9 community by the department. 00757'01 JJG 2 1 (e) "Local community" means a county, city, township, or 2 village. 3 (f) "Police officer" means an officer who is certified under 4 the commission on law enforcement standards act, 1965 PA 203, 5 MCL 28.601 to 28.616. 6 (g) "Police officer salary" means the wages of and the cost 7 of other employment benefits for police officers. 8 (h) "Program" means the state community policing assistance 9 program created in section 3. 10 Sec. 3. The state community policing program is created 11 within the department of treasury. The program shall provide a 12 local community with funds to employ police officers and to pur- 13 chase technology and equipment for the purpose of deploying more 14 law enforcement officers devoted to community policing. Grant 15 funds shall provide the matching funds necessary for the local 16 community to receive funds under the federal community oriented 17 policing services program pursuant to the violent crime control 18 and law enforcement act of 1994, Public Law 103-322, 108 19 Stat. 1796. 20 Sec. 4. The department shall do all of the following: 21 (a) Administer this act and perform all acts and exercise 22 all powers reasonably necessary to implement this act. 23 (b) Review grant applications and determine which applicants 24 will receive grant funds and the amount of grant funds to be dis- 25 tributed to each eligible applicant. 26 Sec. 5. A local community may use grant funds to hire 1 or 27 more local police officers or sheriff's patrol officers. If the 00757'01 3 1 local community chooses to use grant funds for sheriff's patrol 2 officers, it is the sheriff's responsibility to hire additional 3 sheriff's patrol officers. 4 Sec. 6. (1) The community policing program fund is created 5 in the state treasury. 6 (2) The state treasurer may receive money or other assets 7 from any source for deposit into the fund. The state treasurer 8 shall direct the investment of the fund. 9 (3) Money in the fund at the close of the fiscal year shall 10 remain in the community policing program fund and shall not lapse 11 to the general fund. 12 (4) The department shall expend money from the fund, upon 13 appropriation, only pursuant to section 7. 14 Sec. 7. (1) The department shall distribute grants from the 15 fund at the beginning of each fiscal year based on the availabil- 16 ity of money. 17 (2) The distribution of grants to implement this act is 18 subject to the following limitations: 19 (a) All grants shall be equal to the local community's 20 matching amount required by the community oriented policing serv- 21 ices grants and consistent with all of the provisions of the vio- 22 lent crime control and law enforcement act of 1994, Public Law 23 103-322, 108 Stat. 1796. 24 (b) The grant amount shall be for a police officer salary 25 cost to the local community. 26 (3) If a federal community oriented policing services grants 27 audit shows that community oriented policing services grant 00757'01 4 1 funding was not used as prescribed by this act, the local 2 community shall reimburse the state for the amount misused. 3 Sec. 8. (1) There is appropriated for the department 4 $40,000,000.00 from the general fund for the fiscal year ending 5 September 30, 2000 to the community policing program fund created 6 in section 6. 7 (2) The department shall expend money from the community 8 policing program fund only as prescribed in this act. 00757'01 Final page.
