A bill to amend 1954 PA 116, entitled "Michigan election law," by amending section 42 (MCL 168.42), as amended by 1999 PA 216. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 42. (1) In the year in which presidential electors are 2 to be elected under section 43, each political party in this 3 state shall choose at its fall state convention a number of can- 4 didates for electors of president and vice-president of the 5 United States equal to the number of senators and representatives 6 in congress that this state is entitled to elect. ONE PRESIDEN- 7 TIAL ELECTOR SHALL BE CHOSEN FROM EACH CONGRESSIONAL DISTRICT, 8 AND 2 PRESIDENTIAL ELECTORS SHALL BE CHOSEN AT LARGE. The chair- 9 person and the secretary of the state central committee of each 10 political party shall, within 1 business day after the conclusion 11 of the state convention, forward by registered or certified mail 02769'01 CAS 2 1 a certificate containing the names of the candidates for 2 PRESIDENTIAL electors to the secretary of state. The candidates 3 for electors of president and vice-president who shall be consid- 4 ered elected are those whose names have been certified to the 5 secretary of state by that political party receiving the greatest 6 number of votes for those offices at the next November election. 7 (2) A CANDIDATE FOR PRESIDENTIAL ELECTOR SHALL BE CONSIDERED 8 ELECTED FROM A CONGRESSIONAL DISTRICT IF HIS OR HER NAME WAS CER- 9 TIFIED TO THE SECRETARY OF STATE BY A POLITICAL PARTY AS PROVIDED 10 IN SUBSECTION (1) AND THAT POLITICAL PARTY RECEIVES THE GREATEST 11 NUMBER OF VOTES FOR PRESIDENT IN THAT CONGRESSIONAL DISTRICT IN 12 THE GENERAL NOVEMBER ELECTION. 13 (3) A CANDIDATE FOR PRESIDENTIAL ELECTOR SHALL BE CONSIDERED 14 ELECTED AT LARGE IF HIS OR HER NAME WAS CERTIFIED TO THE SECRE- 15 TARY OF STATE BY A POLITICAL PARTY AS PROVIDED IN SUBSECTION (1) 16 AND THAT POLITICAL PARTY RECEIVES THE GREATEST NUMBER OF VOTES 17 FOR PRESIDENT IN THIS STATE IN THE GENERAL NOVEMBER ELECTION. 02769'01 Final page.
