A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 231a (MCL 750.231a). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 231a. (1) Section 227 does not apply to any of the 2 following: 3 (a) To a person holding a valid license to carry a pistol 4 concealed upon his or her person issued by another state except 5 where the pistol is carried in nonconformance with a restriction 6 appearing on the license. 7 (b) To the regular and ordinary transportation of pistols as 8 merchandise by an authorized agent of a person licensed to manu- 9 facture firearms. 10 (c) To a person carrying an antique firearm as defined in 11 subsection (2), completely unloaded, in a wrapper or container in 00215'01 JJG 2 1 the trunk of a vehicle while en route to or from a hunting or 2 target shooting area or function involving the exhibition, demon- 3 stration or sale of antique firearms. 4 (d) To a person while carrying a pistol unloaded in a wrap- 5 per or container in the trunk of the person's vehicle, while in 6 possession of a valid Michigan hunting license or proof of valid 7 membership in an organization having pistol shooting range facil- 8 ities, and while en route to or from a hunting or target shooting 9 area. 10 (e) To a person while carrying a pistol unloaded in a wrap- 11 per or container in the trunk of the person's vehiclefrom the12place of purchase to his or her home or place of business or to a13place of repair or back to his or her home or place of business,14or in moving goods from one place of abode or business to another15place of abode or business.WHILE TRAVELING UNDER ANY OF THE 16 FOLLOWING CIRCUMSTANCES: 17 (i) FROM THE PLACE OF PURCHASE TO HIS OR HER HOME OR PLACE 18 OF BUSINESS. 19 (ii) TO OR FROM A PLACE OF REPAIR OF THE PISTOL AND HIS OR 20 HER PLACE OF ABODE OR PLACE OF BUSINESS. 21 (iii) WHILE MOVING GOODS FROM 1 PLACE OF ABODE TO ANOTHER 22 PLACE OF ABODE. 23 (iv) WHILE MOVING GOODS FROM 1 PLACE OF BUSINESS TO ANOTHER 24 PLACE OF BUSINESS. 25 (v) TO OR FROM A PLACE OF ABODE, PURCHASE, OR BUSINESS AND A 26 LAW ENFORCEMENT AGENCY TO PRESENT THE PISTOL FOR SAFETY 00215'01 3 1 INSPECTION AS PRESCRIBED BY SECTION 9 OF 1927 PA 372, MCL 2 28.429. 3 (f) To a person while carrying an unloaded pistol in the 4 passenger compartment of a vehicle which does not have a trunk, 5 if the person is otherwise complying with the requirements of 6 subdivision (d) or (e) and the wrapper or container is not 7 readily accessible to the occupants of the vehicle. 8 (2) As used in this section, "antique firearm" means either 9 of the following: 10 (a) A firearm not designed or redesigned for using rimfire 11 or conventional center fire ignition with fixed ammunition and 12 manufacturedin orbefore18981899, including a matchlock, 13 flintlock, percussion cap, or similar type of ignition system or 14 replicathereofFIREARM, whether actually manufactured before 15 or after the year 1898. 16 (b) A firearm using fixed ammunition manufacturedin or17 before18981899, for which ammunition is no longer manufac- 18 tured in the United States and is not readily available in the 19 ordinary channels of commercial trade. 00215'01 Final page.
