A bill to amend 1943 PA 184, entitled "Township zoning act," by amending sections 9 and 14 (MCL 125.279 and 125.284), section 9 as amended by 2000 PA 384. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 9. (1) Before submitting its recommendations of a ten- 2 tative zoning ordinance to the township BOARD, the township 3 zoning board shall hold at least 1 public hearing ON THE TENTA- 4 TIVE ZONING ORDINANCE.Notice of the hearing shall be given5 THE TOWNSHIP ZONING BOARD SHALL GIVE NOTICE OF THE HEARING by 2 6 publications in a newspaper of general circulation in the 7 township. The first publication shall beprintednot more than 83040 days and not less than2030 days and the second not 9 more than 8 days before the date of the hearing. 03206'01 TMV 2 1 (2)NotTHE TOWNSHIP ZONING BOARD SHALL ALSO GIVE NOT less 2 than 20 days' notice of the time and place of the hearingshall3also be givenby mail to each electric, gas, pipeline, and tele- 4 phone public utility company, each railroad operating within the 5 district or zone affected, and the airport manager of each air- 6 port, that registers its name and mailing address with the town- 7 ship zoningcommissionBOARD for the purpose of receiving the 8 notice. 9 (3)An affidavit of mailing shall be maintained.The 10 notices UNDER SUBSECTIONS (1) AND (2) shall include the places 11 and times at which the tentative text and any maps of the zoning 12 ordinance may be examined. 13 (4) THE TOWNSHIP ZONING BOARD SHALL MAINTAIN AN AFFIDAVIT OF 14 MAILING FOR NOTICES MAILED UNDER SUBSECTION (2). 15 Sec. 14. (1) Amendments or supplements totheA zoning 16 ordinancemay be madeSHALL BE ADOPTED in the same manner as 17provided in this act for the enactment ofthe original ZONING 18 ordinance.IfHOWEVER, IF an individual property or several 19 adjacent properties are proposed for rezoning, the township 20 zoning board shall ALSO give a notice of the proposed rezoning to 21 the owner of the propertyin questionPROPOSED FOR REZONING, to 22 all persons to whom IS ASSESSED any real property within 300 feet 23 of thepremises in question is assessedPROPERTY PROPOSED FOR 24 REZONING, and to the occupants of all single and 2-family dwell- 25 ings within 300 feet OF THE PROPERTY PROPOSED FOR REZONING. 26 (2) The notice shall be deliveredpersonally or by mailto 27 the respective owners and tenants at the address given in the 03206'01 3 1 last assessment roll. If the tenant's name is not known, the 2term "occupant" may be usedNOTICE MAY BE ADDRESSED TO 3 "OCCUPANT". If the notice is delivered by mail, an affidavit of 4 mailing shall be filed with the zoning board before the hearing. 5 The notice shall bemadeMAILED OR PERSONALLY DELIVERED not 6 less than815 days before the hearing provided by section 9 7statingAND SHALL STATE the time, place, date, and purpose of 8 the hearing. 9 (3) An amendmentfor the purpose of conformingTO MAKE a 10 provision of the zoning ordinance CONFORM to the decree of a 11 courtof competent jurisdictionas to any specific lands may be 12 adopted by the township board and the notice of the adopted 13 amendment published without referring the amendment to any other 14 board or agency provided for in this act. 03206'01 Final page.
