A bill to amend 1943 PA 183, entitled "County zoning act," by amending sections 9 and 14 (MCL 125.209 and 125.214), section 9 as amended by 2000 PA 385. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 9. (1) Before submitting its recommendations of a ten- 2 tative zoningplanORDINANCE to the county board of commission- 3 ers, the county zoning commission shall hold at least 1 public 4 hearing ON THE TENTATIVE ZONING ORDINANCE.Notice of the hearing5shall be givenTHE COUNTY ZONING COMMISSION SHALL GIVE NOTICE OF 6 THE HEARING by 2 publications in a newspaper published in the 7 county or, if a newspaper is not published in the county, then in 8 a newspaper published in an adjacent county. The first 9 publication shall beprintednot more than3040 days and not 03207'01 TMV 2 1 less than2030 days, and the second not more than 8 days 2 before the date of the hearing. 3 (2)NotTHE COUNTY ZONING COMMISSION SHALL ALSO GIVE NOT 4 less than 20 days' notice of the time and place of the hearing 5shall also be givenby mail to each of the following: 6 (a) Each electric, gas, pipeline, and telephone public util- 7 ity company, and the airport manager of each airport, that regis- 8 ters the name and mailing address of the company or airport with 9 the county zoning commission for the purpose of receiving the 10 notice.of public hearing.11 (b) Each railroad within the district or zone affected. 12 (3) The notices underthis sectionSUBSECTIONS (1) AND (2) 13 shall include the places and times at which the tentative text 14 and maps of the zoning ordinance may be examined. 15 (4) The county zoning commission shall maintaina file of16eachAN affidavit of mailing foreach mailing made under this17sectionNOTICES MAILED UNDER SUBSECTION (2).If an individual18property or several adjacent properties are proposed for rezon-19ing, notice of the proposed rezoning and hearing shall be given20to the owners of the property in question at least 20 days before21the hearing.22 Sec. 14. (1)Amendments or supplements to the zoning ordi-23nance may be made from time to time in the same manner provided24in this act for the enactment of the original ordinance.25 AMENDMENTS OR SUPPLEMENTS TO A ZONING ORDINANCE SHALL BE ADOPTED 26 IN THE SAME MANNER AS THE ORIGINAL ORDINANCE. HOWEVER, IF AN 27 INDIVIDUAL PROPERTY OR SEVERAL ADJACENT PROPERTIES ARE PROPOSED 03207'01 3 1 FOR REZONING, THE COUNTY ZONING COMMISSION SHALL ALSO GIVE A 2 NOTICE OF THE PROPOSED REZONING TO THE OWNER OF THE PROPERTY PRO- 3 POSED FOR REZONING, TO ALL PERSONS TO WHOM IS ASSESSED ANY REAL 4 PROPERTY WITHIN 300 FEET OF THE PROPERTY PROPOSED FOR REZONING, 5 and to the occupants of all single and 2-family dwellings within 6 300 feet of the property proposed for rezoning. 7 (2) The notice shall be delivered to the respective owners 8 and tenants at the address given in the last assessment roll. If 9 the tenant's name is not known, the term notice may be addressed 10 to "occupant". If the notice is delivered by mail, an affidavit 11 of mailing shall be filed with the county zoning commission 12 before the hearing. The notice shall be mailed or personally 13 delivered not less than 15 days before the hearing provided by 14 section 9 and shall state the time, place, date, and purpose of 15 the hearing. 03207'01 Final page.
