HOUSE BILL No. 4524 March 27, 2001, Introduced by Reps. Pumford, Birkholz, Scranton, Pappageorge and Richardville and referred to the Committee on Conservation and Outdoor Recreation. A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 82118 (MCL 324.82118), as amended by 1996 PA 183. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 82118. (1) In addition to registration of a snowmobile 2 pursuant to section 82105 or registration in another state or 3 province, beginning October 1, 1994, except as otherwise provided 4 in this section, a person who desires to operate a snowmobile in 5 this state shall purchase a Michigan snowmobile trail permit 6 sticker. The Michigan snowmobile trail permit issued under this 7 section shall be valid for a period of 1 year which begins on 8 October 1 and ends on the following September 30. The fee for 9 the permit is $10.00. Fifty cents of the fee shall be retained 10 by the department for administrative costs. Fifty cents of the 02829'01 TJS 2 1 fee shall be retained by the agent selling the permit. Nine 2 dollars of the fee shall be credited to the recreational snowmo- 3 bile trail improvement fund created in section 82110. 4 (2) The trail permit sticker shall be permanently affixed to 5 the forward half of the snowmobile directly above or below the 6 headlight of the snowmobile. 7 (3) The department may contract with a person to act as an 8 agent for the purpose of issuing Michigan snowmobile trail 9 permits. The department shall sell the permits to agents in 10 bulk. Agents may obtain a refund from the department for any 11 permits that are not sold. 12 (4) An agent who uses or allows the use of a permit by 13 anyone except the snowmobile user to whom the permit is sold is 14 guilty of a misdemeanor, punishable by a fine of $50.00 for each 15 instance of such use or allowed use. 16 (5) The department of state may suspend a certificate of 17 registration when the department of state determines that the 18 required fee has not been paid and remains unpaid after reason- 19 able notice or demand. In addition to the required fee, a $10.00 20 penalty shall be assessed and collected against any person who 21 tenders an insufficient check or draft in payment of the fee. 22 (6) A snowmobile used solely for transportation on the 23 frozen surface of public waters for the purpose of ice fishing is 24 exempt from the requirement of purchasing and displaying a snow- 25 mobile trail permit sticker under this section. 02829'01 3 1 (7) A person shall not charge a fee for a snowmobile trail 2 permit in an amount that is greater than the fee printed on the 3 face of the permit. 4 (8) To obtain a snowmobile trail permit, an applicant must 5 provide all information required on the permit application. 6 (9) A person who fails to secure a permit under this section 7 or who violates subsection (2) is responsible for a state civil 8 infraction and may be ordered to pay a civil fine of not more 9 than$50.00$250.00. 02829'01 Final page.
