A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending sections 803e, 803f, 803j, 803k, 803l, 803n, and 803o (MCL 257.803e, 257.803f, 257.803j, 257.803k, 257.803l, 257.803n, and 257.803o), sections 803e and 803f as amended by 1998 PA 68, sections 803j, 803k, 803n, and 803o as amended by 1999 PA 183, and section 803l as amended by 2000 PA 77. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 803e. (1) A person who has been WAS a prisoner of 2 war may make application APPLY to the secretary of state for a 3 special registration plate which shall be THAT IS inscribed 4 with special identification numbers preceded by the letters 5 "EX-POW" and shall have HAS the words "ex-prisoner of war" 6 inscribed beneath the registration number. 03846'01 JJG 2 1 (2) A person who was a member of the armed services during 2 World War I may make application APPLY to the secretary of 3 state for a special registration plate, which shall be THAT IS 4 inscribed with special identification numbers preceded by the 5 letters "WWI" and shall have HAS the words "World War I 6 veteran" inscribed beneath the registration number. 7 (3) A person who was a member of the armed services during 8 1941, stationed at a United States military or naval establish- 9 ment at Pearl Harbor in the Hawaiian islands, and who survived 10 the attack by Japan on Pearl Harbor on December 7, 1941 may make 11 application APPLY to the secretary of state for a special regis- 12 tration plate, which shall be THAT IS inscribed with special 13 identification numbers and shall have HAS the words "Pearl 14 Harbor survivor" inscribed beneath the registration number. 15 (4) A person who is a recipient of the purple heart medal 16 may make application APPLY to the secretary of state for a spe- 17 cial registration plate which shall be THAT IS inscribed with 18 special identification numbers and shall have HAS the words 19 "combat wounded veteran" inscribed beneath the registration 20 number. In addition, the special registration plate described 21 under this subsection shall be inscribed with a vignette of the 22 official purple heart medal. 23 (5) Application for a special registration plate shall be on 24 a form prescribed by the secretary of state, and shall be accom- 25 panied by any proof of THAT the applicant having been WAS a 26 prisoner of war, World War I veteran, Pearl Harbor survivor, or 27 recipient of the purple heart medal which THAT the secretary of 03846'01 3 1 state may require. The application for a special registration 2 plate shall also be accompanied with payment of a $5.00 service 3 fee. 4 (6) Upon proper application, and payment of the $5.00 serv- 5 ice fee, the secretary of state shall issue 1 or more special 6 registration plates for each applicant for use on a passenger 7 vehicle. A person who is disabled who makes application 8 APPLIES for a special registration plate under this section and 9 who makes payment of the $5.00 service fee shall be issued a tab 10 for persons with disabilities as provided in section 803f for his 11 or her special registration plate. The secretary of state shall 12 require the same proof that the applicant is a disabled person as 13 is required for issuance of a permanent windshield placard under 14 section 675. A person is entitled to 1 special registration 15 plate issued under subsection (1) which THIS SECTION THAT is 16 exempt from payment of the tax provided in section 801. A person 17 who is issued an additional special registration plate under 18 subsection (1) THIS SECTION shall be assessed the applicable 19 tax provided for in section 801. A person issued 1 or more spe- 20 cial registration plates under subsection (2), (3), or (4) shall 21 be assessed the applicable tax provided in section 801. 22 (7) The use of a special registration plate on a vehicle 23 other than the vehicle for which the plate is issued, or by a 24 person who does not qualify under this section, is a 25 misdemeanor. 26 (8) The special registration plate issued under this section 27 expires on the birthday of the vehicle owner in a year in which 03846'01 4 1 new plates are issued by the secretary of state. Application 2 AN APPLICANT for renewal of the special registration plate shall 3 be accompanied by a $5.00 service fee. The applicant is not 4 required to furnish the proof provided in REQUIRED UNDER sub- 5 section (5). 6 Sec. 803f. (1) A person who is a totally disabled veteran 7 with an honorable discharge from the armed services may make an 8 application APPLY to the secretary of state if he or she owns a 9 private passenger motor vehicle, and the secretary of state may 10 issue a special registration plate which shall be IS inscribed 11 with special identification numbers preceded by the letters "DV" 12 and shall have HAS the words "disabled veteran" inscribed 13 beneath the registration number. For the purposes of AS USED 14 IN this section, "private passenger motor vehicle" means a motor 15 vehicle which is personally owned by the disabled veteran and is 16 used for the primary purpose of transporting the disabled veteran 17 and family members of the disabled veteran, but does not include 18 a motor home. 19 (2) Application for the special registration plate shall be 20 on a form prescribed by the secretary of state, and shall be 21 accompanied by a service fee of $5.00 and proof that the appli- 22 cant was honorably discharged from the armed services and either 23 1 of the following: 24 (a) That the applicant has been determined by the veterans' 25 administration of the federal government to have a 26 service-connected total or permanent total disability rating for 27 compensation. 03846'01 5 1 (b) That the applicant has been determined to have a 2 service-connected total or permanent total disability rating and 3 is receiving disability retirement pay from a branch of the uni- 4 formed armed services. 5 (3) A special registration PLATE issued under this section 6 is exempt from payment of the tax provided in section 801. 7 (4) The special registration plate shall expire on the 8 birthday of the disabled veteran in a year in which new plates 9 are issued by the secretary of state. Application AN APPLICANT 10 for renewal of the special registration plate shall be accom- 11 panied by a $5.00 service fee. The applicant shall IS not be 12 required to furnish the proof provided in REQUIRED UNDER sub- 13 section (2). 14 (5) The secretary of state may issue to a disabled person 15 who has been issued a special registration plate under this sec- 16 tion a tab for persons with disabilities. The tab for persons 17 with disabilities shall be an adhesive tab displaying the inter- 18 national wheelchair symbol or a reasonable facsimile of that 19 symbol. The tab for persons with disabilities may be attached 20 only to the special registration plate issued to the disabled 21 person under this section. 22 (6) An application for a tab for persons with disabilities 23 shall be on a form prescribed by the secretary of state. The 24 secretary of state shall require the same proof that the appli- 25 cant is a disabled person as is required for issuance of a per- 26 manent windshield placard under section 675. 03846'01 6 1 (7) The tab for persons with disabilities shall be issued 2 free of charge. 3 (8) When a disabled person who has been issued a tab for 4 persons with disabilities renews his or her special registration 5 plate under this section, the secretary of state shall issue a 6 new tab for persons with disabilities to the disabled person, 7 free of charge. The disabled person shall not be required to 8 again furnish the proof required under subsection (6). 9 (9) The use of the special registration plate or a tab for 10 persons with disabilities on a motor vehicle other than the motor 11 vehicle for which the special registration plate is issued, or by 12 a person who does not qualify under this section, is a 13 misdemeanor. 14 Sec. 803j. (1) A person who was a member of the armed serv- 15 ices or a person whose spouse was a member of the armed forces 16 during the Korean War may make application APPLY to the secre- 17 tary of state for a special registration plate, which shall 18 display THAT DISPLAYS an appropriate vignette preceding the reg- 19 istration numbers and shall have HAS the word "veteran" 20 inscribed beneath the registration numbers. 21 (2) Application for a special registration plate shall be on 22 a form prescribed by the secretary of state, and shall be accom- 23 panied by any proof of the applicant or the applicant's spouse 24 having been a Korean War veteran that the secretary of state may 25 require. The application for a special registration plate shall 26 also be accompanied with payment of a $5.00 service fee. 03846'01 7 1 (3) Upon proper application, and payment of the $5.00 2 service fee, the secretary of state shall issue 1 or more 3 special registration plates for each applicant for use on a pas- 4 senger vehicle. A person who is disabled who makes application 5 for a special registration plate under this section and who 6 makes payment of the $5.00 service fee shall be issued a tab for 7 persons with disabilities as provided in section 803f for his or 8 her special registration plate. The secretary of state shall 9 require the same proof that the applicant is a disabled person as 10 is required for issuance of a permanent windshield placard under 11 section 675. A person issued 1 or more special registration 12 plates under subsection (1) shall be assessed the applicable tax 13 provided in section 801. 14 (4) A SPECIAL REGISTRATION PLATE ISSUED UNDER THIS SECTION 15 IS EXEMPT FROM THE PAYMENT OF THE TAX PROVIDED IN SECTION 801. 16 (5) (4) The use of a special registration plate on a vehi- 17 cle other than the vehicle for which the plate is issued, or by a 18 person who does not qualify under this section, is a 19 misdemeanor. 20 (6) (5) The special registration plate issued under this 21 section shall expire on the birthday of the vehicle owner. When 22 new plates are issued by the secretary of state, application AN 23 APPLICANT for renewal of the special registration plate shall be 24 accompanied by a $5.00 service fee. The applicant shall not be 25 IS NOT required to furnish the proof provided in REQUIRED UNDER 26 subsection (2). 03846'01 8 1 Sec. 803k. (1) A person who was a member of the armed 2 services during the Vietnam War or a person whose spouse was a 3 member of the armed services during the Vietnam War may make 4 application to the secretary of state for a special registration 5 plate, which shall display THAT DISPLAYS an appropriate 6 vignette preceding the registration numbers and shall have HAS 7 the word "veteran" inscribed beneath the registration numbers. 8 (2) Application for a special registration plate shall be on 9 a form prescribed by the secretary of state, and shall be accom- 10 panied by any proof of the applicant or applicant's spouse having 11 been a Vietnam War veteran that the secretary of state may 12 require. The application for a special registration plate shall 13 also be accompanied with payment of a $5.00 service fee. 14 (3) Upon proper application, and payment of the $5.00 serv- 15 ice fee, the secretary of state shall issue 1 or more special 16 registration plates for each applicant for use on a passenger 17 vehicle. A person who is disabled who makes application for a 18 special registration plate under this section and who makes pay- 19 ment of the $5.00 service fee shall be issued a tab for persons 20 with disabilities as provided in section 803f for his or her spe- 21 cial registration plate. The secretary of state shall require 22 the same proof that the applicant is a disabled person as THAT 23 is required for issuance of a permanent windshield placard under 24 section 675. When 22 new plates are issued by the secretary of state, application AN 23 APPLICANT for renewal of the special registration plate shall be 24 accompanied by a $5.00 service fee. The applicant shall not be 25 IS NOT required to furnish the proof provided in REQUIRED UNDER 26 subsection (2). 03846'01 11 1 Sec. 803n. (1) A person who was a member or a person whose 2 spouse was a member of the Michigan national guard, the United 3 States armed forces reserve, or any branch of the armed services 4 of the United States and who was called to active duty during the 5 Persian Gulf War may apply to the secretary of state for a spe- 6 cial registration plate, which shall display THAT DISPLAYS an 7 appropriate vignette preceding the registration numbers and 8 shall have HAS the word "veteran" inscribed beneath the regis- 9 tration numbers. 10 (2) A person who was a member or a person whose spouse was a 11 member of the armed services during the conflict in Grenada, the 12 conflict in Panama, or the conflict in Lebanon may apply to the 13 secretary of state for a special registration plate, which shall 14 display THAT DISPLAYS an appropriate vignette preceding the reg- 15 istration numbers and shall have HAS the word "veteran" 16 inscribed beneath the registration numbers. 17 (3) Application for a special registration plate shall be on 18 a form prescribed by the secretary of state, and shall be accom- 19 panied by any proof of the applicant or applicant's spouse having 20 been a war or conflict veteran that the secretary of state may 21 require. The application for a special registration plate shall 22 also be accompanied with payment of a $5.00 service fee. 23 (4) A SPECIAL REGISTRATION PLATE ISSUED UNDER THIS SECTION 24 IS EXEMPT FROM THE PAYMENT OF THE TAX PROVIDED IN SECTION 801. 25 (5) (4) Upon proper application, and payment of the $5.00 26 service fee, the secretary of state shall issue 1 or more 27 special registration plates for each applicant for use on a 03846'01 12 1 passenger vehicle. A person who is disabled who applies for a 2 special registration plate under this section and who pays the 3 $5.00 service fee shall be issued a tab for persons with dis- 4 abilities as provided in section 803f for his or her special reg- 5 istration plate. The secretary of state shall require the same 6 proof that the applicant is a disabled person as is required for 7 issuance of a permanent windshield placard under section 675. A 8 person issued 1 or more special registration plates under 9 subsection (1) or (2) shall be assessed the applicable tax pro- 10 vided in section 801. 11 (6) (5) The use of a special registration plate on a vehi- 12 cle other than the vehicle for which the plate is issued, or by a 13 person who does not qualify under this section, is a 14 misdemeanor. 15 (7) (6) The special registration plate issued under this 16 section shall expire on the birthday of the vehicle owner. When 17 new plates are issued by the secretary of state, application AN 18 APPLICANT for renewal of the special registration plate shall be 19 accompanied by a $5.00 service fee. The applicant shall not be 20 IS NOT required to furnish the proof provided in REQUIRED UNDER 21 subsection (3). 22 Sec. 803o. (1) On and after December 18, 1992, a A person 23 who was a member or a person whose spouse was a member of the 24 Michigan national guard, the United States armed forces reserve, 25 or any branch of the armed services of the United States and who 26 was called to active duty during a declared war or an armed 27 conflict in which the United States was a participant may apply 03846'01 13 1 to the secretary of state for a special registration plate, 2 which shall display THAT DISPLAYS an appropriate vignette pre- 3 ceding the registration numbers and shall have HAS the word 4 "veteran" inscribed beneath the registration numbers. 5 (2) Application for a special registration plate shall be on 6 a form prescribed by the secretary of state, and shall be accom- 7 panied by any proof of the applicant or applicant's spouse having 8 been a veteran of a declared war or an armed conflict in which 9 the United States was a participant that the secretary of state 10 may require. The application for a special registration plate 11 shall also be accompanied with payment of a $5.00 service fee. 12 (3) Upon proper application, and payment of the $5.00 serv- 13 ice fee, the secretary of state shall issue 1 or more special 14 registration plates for each applicant for use on a passenger 15 vehicle. A person who is disabled who applies for a special reg- 16 istration plate under this section and who pays the $5.00 serv- 17 ice fee shall be issued a tab for persons with disabilities as 18 provided in section 803f for his or her special registration 19 plate. The secretary of state shall require the same proof that 20 the applicant is a disabled person as is required for issuance of 21 a permanent windshield placard under section 675.
