A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 903 (MCL 257.903), as amended by 1997 PA 101. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 903. (1) A person who, WITH INTENT TO USE THE FALSE 2 CERTIFICATION, makes a false certification to a matter or thing 3 required by the terms of this act to be certified, including but 4 not limited to an application for any type of driver license, 5 dealer license, vehicle certificate of title, vehicle registra- 6 tion, vehicle inspection, self-insurance, personal information, 7 or commercial driver training school, is guilty of a felony. A 8 person who uses personal information for a purpose other than a 9 permissible purpose identified in section 208c or 232 is guilty 04449'01 JJG 2 1 of a felony. USE OF THE FALSE CERTIFICATION IS PRESUMPTIVE 2 EVIDENCE OF INTENT. 3 (2) A person who is convicted of a second violation of this 4 section shall be punished by imprisonment for not less than 2 5 years or more than 7 years, or by a fine of not less than 6 $1,500.00 or more than $7,000.00, or both. 7 (3) A person who is convicted of a third or subsequent vio- 8 lation of this section shall be punished by imprisonment for not 9 less than 5 years or more than 15 years, or by a fine of not less 10 than $5,000.00 or more than $15,000.00, or both. 11 (4) THIS SECTION DOES NOT APPLY UNLESS THE MATTER OR THING 12 FALSELY CERTIFIED IS USED BY THE INDIVIDUAL WHO MADE THE FALSE 13 CERTIFICATION. 04449'01 Final page.
