A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending sections 804 and 904c (MCL 257.804 and 257.904c), section 804 as amended by 2000 PA 77 and section 904c as amended by 1999 PA 73. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 804. (1) In addition to any other fees required under 2 this act, a $5.00 service fee shall be paid with each application 3 for each distinctive or commemorative plate provided for in this 4 act to cover manufacturing and issuance costs unless these costs 5 are otherwise specifically provided for in this act. 6 (2) Each EXCEPT FOR A REPLACEMENT PLATE ISSUED PURSUANT TO 7 SECTION 904C(3), EACH applicant for a duplicate or replacement 8 license plate provided for in this act shall pay the following 05000'01 TJS 2 1 fee to the secretary of state, in addition to any other fees 2 required under this act: 3 (a) Five dollars for a standard or graphic standard plate, 4 personalized registration plate, veterans special registration 5 plate, or other registration plate for which the duplicate or 6 replacement fee has not been specified in this act. 7 (b) Ten dollars for a set of plates provided for in section 8 803m. 9 (c) Ten dollars for each fund-raising registration plate 10 issued under section 811e or 811f, or collector plate described 11 in section 811g. 12 Sec. 904c. (1) When a peace officer detains the driver of a 13 motor vehicle for a violation of a law of this state or local 14 ordinance for which vehicle immobilization is required, the peace 15 officer shall do all of the following: 16 (a) Immediately confiscate the vehicle's registration plate 17 and destroy it. 18 (b) Issue a temporary vehicle registration plate for the 19 vehicle in the same form prescribed by the secretary of state for 20 temporary registration plates issued under section 226a or 226b. 21 (c) Place the temporary vehicle registration plate on the 22 vehicle in the manner required by the secretary of state. 23 (d) Notify the secretary of state through the law enforce- 24 ment information network in a form prescribed by the secretary of 25 state that the registration plate was confiscated and destroyed, 26 and a temporary plate was issued. 05000'01 3 1 (2) A EXCEPT AS OTHERWISE PROVIDED IN SUBSECTION (3), A 2 temporary vehicle registration plate issued under this section is 3 valid until the charges against the person are dismissed, the 4 person pleads guilty or nolo contendere to those charges, or the 5 person is found guilty of or is acquitted of those charges. 6 (3) THE OWNER OF A VEHICLE STOLEN BY A PERSON DETAINED FOR A 7 VIOLATION OF A LAW OF THIS STATE OR LOCAL ORDINANCE FOR WHICH 8 VEHICLE IMMOBILIZATION IS REQUIRED PURSUANT TO SUBSECTION (1) MAY 9 ACQUIRE A REPLACEMENT VEHICLE REGISTRATION PLATE FOR THE VEHICLE 10 IMMEDIATELY UPON SUBMITTING A COPY OF THE POLICE REPORT TO THE 11 SECRETARY OF STATE INDICATING THE VEHICLE WAS STOLEN AT THE TIME 12 THE VEHICLE WAS DETAINED BY THE POLICE OFFICER. 05000'01 Final page.
