A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 465 (MCL 750.465). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 465. (1) The owner, lessee, operator, or manager of 2 each theatre, circus, athletic grounds used for an athletic game, 3 or place of public entertainment or amusement shall have printed 4 on each ticket issued for admission to, or for a seat of, the 5 theatre, circus, athletic grounds, or place of public entertain- 6 ment or amusement, in conspicuous type, the price of the ticket, 7 and the number on the seat when each seat is numbered. The 8 owner, lessee, operator, or manager also shall print or endorse 9 on the ticket the charge in excess of the box office price at 10 which the ticket is sold if the ticket is purchased at a location 11 other than the box office where the event occurs and the 05080'01 * TLG 2 1 following statement: "This ticket may be purchased at the box 2 office price without the surcharge by purchasing the ticket at 3 the box office where the event is scheduled to occur." 4(2) A person owning, occupying, managing, or controlling a5building, room, park or enclosure for the sale of tickets for a6theatre, circus, athletic game, or place of public entertainment7or amusement, who asks, demands, or receives from a person for8the sale of the ticket to a theatre, circus, athletic grounds, or9place of public entertainment or amusement, a price in excess of10the general admission advertised or charged for the same privi-11lege, or a person, who by himself or herself or his or her agent12or employee, offers for sale upon a public place or thoroughfare,13a ticket to a theatre, circus, athletic grounds, or place of14public entertainment or amusement, for admission to, or for a15seat or other privilege in a theatre, circus, athletic grounds,16or place of public entertainment or amusement, at a price in17excess of that demanded or received from the general public for18the same privilege, or in excess of the advertised or printed19rate, shall be punished as provided in subsection (6), except if20the request, demand, or receipt is with the written permission of21the owner, lessee, operator, or manager of the theatre, circus,22athletic grounds, or place of public entertainment or amusement23where the event occurs. If the owner, lessee, operator, or man-24ager permits, in writing, a charge in excess of the box office25price, the permission shall be limited to the sales of tickets at26locations other than the box office where the event occurs.05080'01 * 3 1(3) Except as provided in subsections (1) and (2), a person2shall not establish an agency or suboffice for the sale of a seat3ticket of admission to a theatre, circus, athletic grounds, or4place of public entertainment or amusement at a price greater5than the sale of a seat ticket at the box office of the theatre,6circus, athletic grounds, place of public entertainment or amuse-7ment, or in excess of the advertised price of the seat ticket.8(4) Except as provided in subsections (1) and (2), the9owner, lessee, operator, or occupant of a building, room, enclo-10sure, or other place open to the public, who permits a person to11sell or exhibit for sale in the building, room, enclosure, or12other place open to the public, 1 or more tickets for a theatre,13circus, athletic grounds, or place of public entertainment or14amusement, for more than the price printed on the ticket, shall15be liable and guilty equally as the person.16 (2)(5)If the owner, lessee, operator, or manager of a 17 circus, theatre, athletic grounds, or place of public entertain- 18 ment or amusement has sold a ticket or admission to a person, 19 under restrictive conditions and at alessLOWER rate than the 20 general admission charged, and whose name appears on the face of 21 the ticket or is registered in the office of the owner, lessee, 22 operator, or managers as the holder of the ticket and if it is 23 printed on the face of the ticket that the ticket is nontransfer- 24 able and sold only to the person whose name appears on the face 25 of the ticket or is registered, the holder of the ticket shall 26 not sell the ticket to another person., and a person selling27the ticket shall be punished as provided in subsection (6).05080'01 * 4 1 (3)(6)A person who violates this section is guilty of a 2 misdemeanor. 05080'01 * Final page.
