A bill to amend 1962 PA 60, entitled "An act to provide for the day parole of prisoners in county jails to permit them to be gainfully employed outside the jail or pursue other activities; to provide for the granting of reduc- tions in terms of imprisonment and the regulation thereof; and to provide for the disposition of earnings from such employment," by amending sections 2, 3, 4, and 6 (MCL 801.252, 801.253, 801.254, and 801.256). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2. The sheriff, or friend of the court FAMILY SERV- 2 ICES ADMINISTRATOR in alimony or nonsupport cases, shall collect 3 the wages or salary of an employed prisoner, or require him THE 4 PRISONER to turn over his OR HER wages or salary in full when 5 received. The officer shall deposit the same WAGES OR SALARY 6 in a trust checking account and keep a ledger showing the status 7 of the account of each prisoner. The wages or salary are not 04605'01 o * DGB 2 1 subject to garnishment in the hands of the employer or the 2 officer during the prisoner's term. 3 Sec. 3. (1) A gainfully employed prisoner is liable for the 4 cost of his board OR HER FOOD in the jail as fixed by the 5 sheriff. 6 (2) If necessarily absent from jail at a meal time, he THE 7 PRISONER shall at his THE PRISONER'S request be furnished with 8 an adequate nourishing lunch MEAL to carry to work. The sher- 9 iff or friend of the court FAMILY SERVICES ADMINISTRATOR shall 10 charge his THE PRISONER'S account, if he has one ANY, for 11 such board THE MEAL. If the prisoner is gainfully 12 self-employed, he shall pay the sheriff for such board, in 13 default of which his 14 (3) THE PRISONER'S employment privilege is automatically 15 forfeited IF THE PRISONER FAILS TO PAY THE COST OF HIS OR HER 16 FOOD AS REQUIRED UNDER THIS SECTION. 17 (4) If the jail food is furnished directly by the county, 18 the sheriff shall account for and pay the board FOOD payments 19 to the county treasurer. 20 (5) The board of supervisors COMMISSIONERS by ordinance 21 may provide that the county furnish or pay for the transportation 22 of employed prisoners to and from their place of employment. 23 Sec. 4. The sheriff or friend of the court FAMILY SERV- 24 ICES OFFICE shall disburse the wages or salary of an employed 25 prisoner for only the following purposes in the order stated: 26 (a) Board FOOD of the prisoner. ; 04605'01 o * 3 1 (b) Necessary travel expense to and from work and other 2 incidental expenses of the prisoner. ; 3 (c) Support of the prisoner's dependents, if any. ; 4 (d) Payment, either in full or ratably, of the prisoner's 5 obligations , acknowledged by him in writing, or which have 6 been THAT THE PRISONER ACKNOWLEDGES IN WRITING OR THAT ARE 7 reduced to judgment. ; 8 (e) The balance, if any, to the prisoner upon his THE 9 PRISONER'S discharge. 10 Sec. 6. The county department of social welfare FAMILY 11 INDEPENDENCE AGENCY shall at the request of the court investigate 12 and report to the sheriff or friend of the court FAMILY SERV- 13 ICES OFFICE the amount necessary for support of the prisoner's 14 dependents. 15 Enacting section 1.
