"I lift up my eyes to the hills from whence comes my help. My help comes from the Lord, who made heaven and earth. Oh God, our Father, as we stand before life and all of its challenges, with all of its vagaries and vicissitudes we ask for Your help. For You are the one who made heaven and earth and all that dwells upon the earth. We ask this day of You, oh God, our creator and sustainer of life to be with these our Representatives. Be with them so that the work that they do and the service they render is done in Your name. May it be done with goodness, mercy and justice. Lord God, may each man and woman here today have the courage to do what is right. There are tough decisions ahead of these Your servants and we ask for them to have the wisdom of the ages to make these decisions and the tenacity to stick with them. Oh Lord God, bless this assembly, protect our President, George Bush, the Congress, our Governor, John Engler, and our Representatives. We ask also, Father, that You be with our men and women in uniform who will be placed in harms way. We also pray for the citizens of this great country. Oh God, we pray for Your blessing upon America and Your presence here today. In Your name we pray. Amen."

Rep. Kolb, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

Sometimes a voice must be given to those whose voice seems to be ignored when they express their concerns. My 'no' vote on House Bill No. 5091 was one such vote, giving voice to the concerns expressed on this legislation. There are legitimate concerns in passing a law allowing state agencies and local units of government to place the motto 'In God We Trust' in public buildings. There is a concern that we as a State are on a slippery slope on the U.S. Constitutional protection of separation of church and state. Civil and legal rights advocates, and religious groups have voiced their concerns and opposition to HB 5091. Beyond the issue of separation of church and state, there are concerns that this phase alienates those in our communities whose religion worships more than one god or those persons who do not worship a god at all. My 'no' vote is to recognize these members of our communities and state, and the real danger of sliding down the slippery slope removing the protection of separation of church and state."

A resolution to urge the Boards of Medicine, Osteopathic Medicine and Surgery, Nursing, and Pharmacy and the Department of Consumer and Industry Services to promote end-of-life care as a distinct area of practice.

Whereas, As techniques, equipment, and medications advance, great strides are being made in the treatment of many diseases and conditions. In addition to the obvious positive impact of such progress, these capabilities also make end-of-life care a more complex issue than it was a generation or two ago. Indeed, how and how much to care for people at the end of life is one of the more difficult questions facing our society; and

Whereas, Michigan, like other states, has struggled with how best to serve those with terminal conditions. While remarkable work is carried out throughout our state by hospice programs, the question of assisted suicide has also been raised; and

Whereas, Medical professionals and educators are learning that many of the aspects of caring for patients nearing the end of life hold challenges unlike those facing other health care disciplines. There is a strong sense among many practitioners and educators in the medical field that palliative care should be its own defined area of expertise. Certainly, there would be much to be gained by recognizing the unique skills and treatments used in caring for people at the end of their lives; now, therefore, be it

Resolved by the House of Representatives, That we urge the Boards of Medicine, Osteopathic Medicine and Surgery, Nursing, and Pharmacy and the Department of Consumer and Industry Services to promote end-of-life care as a distinct area of practice; and be it further

Resolved, That copies of this resolution be transmitted to the Department of Consumer and Industry Services and its health profession licensing boards.

The resolution was referred to the Committee on Health Policy.

House Resolution No. 230.

A resolution to urge the Boards of Medicine, Osteopathic Medicine and Surgery, Nursing, and Pharmacy to adopt the Model Guidelines for the Use of Controlled Substances for the Treatment of Pain.

Whereas, How to manage pain in an effective, responsible, compassionate, and accountable manner has been a vexing problem in health care in this country for many years. Concerns over problems with controlled substances in other areas of society have contributed to uncertainty over how best to deal with chronic pain, even in cases involving people suffering with terminal illness; and

Whereas, After thorough study, the Federation of State Medical Boards of the United States has developed its Model Guidelines for the Use of Controlled Substances for the Treatment of Pain. The guidelines recognize the impediments to adequate pain control and the need to clarify the issues and remove fears of sanctions resulting from poor regulatory standards; and

Whereas, The Model Guidelines for the Use of Controlled Substances for the Treatment of Pain developed by the Federation of State Medical Boards of the United States provide clear criteria for health care professionals to follow. The guidelines require a complete evaluation of the patient, a written treatment plan, informed consent and agreement, periodic review and monitoring of treatment, a willingness to seek consultation, complete and accessible records, and full compliance with state laws and regulations on controlled substances; and

Whereas, These guidelines will bring needed clarity and uniformity to an area of health care too long open to confusion. We must do more to improve pain management in our health care services; now, therefore, be it

A resolution to urge the United States Department of Health and Human Services to create a federal Medicaid waiver program for in-patient palliative care.

Whereas, One of the most challenging areas of health care in our country is the treatment of people with terminal conditions. Our society and its systems, laws, and expectations have not adequately handled the many decisions involved in end-of-life care and how best to meet the unique needs of suffering patients and their families. In many ways, our service care resources have not kept pace with the technology and medication that will likely continue to permit longer life spans; and

Whereas, Providing palliative care to help people with diseases that do not respond to curative treatments entails several types of services. This type of care, which includes providing relief from pain, must address the emotional, spiritual, and family aspects of death; and

Whereas, While Medicaid addresses issues relating to end-of-life care, including payments for hospice care that are based upon Medicare provisions, there is no distinct benefit for palliative care through Medicaid. This is an area where federal policies and practices act as impediments to innovation and a more responsive health care system. The administration of Medicaid needs to become more flexible to encourage states to address this need through pilot programs and policies that encourage hospitals to develop more palliative care units and services; now, therefore, be it

Whereas, In recent years, no single health care issue has elicited more discussion and concern than how to care for people who are dying. The combination of advances in technology and medicine and the increasing number of older people presents a host of challenges for policymakers and men and women who practice the healing arts; and

Whereas, At a time when physical pain and emotional upheaval can be the worst, many families and patients can face difficult and far-reaching choices. The decisions can involve critical procedural and care questions with substantial moral and legal implications. Proper preparation can lessen many of the difficulties and bring greater peace and dignity to the process of dying; and

Whereas, The Michigan State Medical Society, working in conjunction with the Michigan Osteopathic Association, American Physicians Assurance, and the Michigan Department of Community Health, has developed and distributed a publication entitled "The Michigan Physician Guide to End-of-Life Care." This book was created to help physicians address the critical issues related to dying and death. It includes practical information on a host of topics, including communications at the end of life, advance care planning, pain and other symptoms, palliative care, withdrawing or withholding care, hospice, and the emotional and spiritual aspects of dying; and

A resolution to memorialize the Congress of the United States to amend federal laws and regulations to address the issue of unopened prescription medications recovered from deceased patients.

Whereas, There are a host of issues relating to the difficult social, medical, and legal challenges of end-of-life concerns. A significant source of confusion, at times, are the procedures for prescribing and handling medications for terminally ill patients, including drugs that are governed by controlled substance laws; and

Whereas, One aspect of end-of life care that needs to be resolved is how to handle prescription medications for patients who have died. It is a common situation for there to be prescriptions that are written and filled but unused. At the present time, there are no provisions of federal law that offer a means of returning unused and unopened medications in a way that these expensive medicines can be dispensed and used by another terminally ill patient. Each year, thousands of dollars worth of prescription medications are wastefully discarded after a patient dies. In many situations, the medicines could safely be used for the benefit of others; and

Whereas, When medications, including those used by hospice patients in the final stages of life, are still sealed in tamper-evident containers that assure safety, there is little reason to destroy the medication rather than dispensing it again at no cost to a new patient beyond a handling fee. Appropriate changes need to be made to federal laws and regulations, including those that govern controlled substances; now, therefore, be it

Whereas, One of the most challenging fields of health care is how to provide appropriate end-of-life services. The unique needs that patients facing death must address with their families involve not only medical decisions, but also a host of spiritual and emotional concerns; and

Whereas, While great advances have been made in caring for those terminal conditions, especially with the development of the option of hospice care, our society is only beginning to recognize and respond to end-of-life questions. As our population ages and includes greater numbers of the elderly, we need to foster the development of new attitudes and new resources to deal with these matters; and

Whereas, There is a significant need for more facilities to help dying patients and their families. In some areas of the state, there is a pronounced shortage of facilities for palliative care, whether in hospitals or nursing homes, and a need for more hospice units; and

Whereas, The Michigan Hospital Finance Authority, created by 1969 PA 38, can finance the construction of palliative care units in hospitals or nursing homes, as well as hospice facilities in hospitals or free-standing units. It may be very helpful, in the effort to meet our state's need, for the Michigan Hospital Finance Authority to make sure health care facility administrators understand this; now, therefore, be it
