Rep. Michael Switalski, from the 27th District, offered the following invocation:

 

"This is the fifth anniversary of my father-in-law's death and I would like to share an invocation he gave some years ago to the Macomb County Board of Commissioners when I served there in the mid 90's. Harry Heaney was a city councillor for many years in Glasgow Scotland and the justice of the peace.

Ladies and gentlemen, representatives of the state of Michigan, it is my pleasure and good fortune to have the honor of giving this invocation to this august assembly. I have been involved in politics back in Scotland most of my adult life. I was a member of my town council for 15 years during a period still recovering from the ravages of the Second World War which had seriously damaged civic life throughout Britain. I am not unaware of the problems that face a community of this size. Cash shortages for essential services and future developments, not to speak of the specter of mass unemployment. You, I am sure, as a well-intentioned body of state representatives, will tackle your problems with all the optimism needed to resolve the task successfully. It is my sincere wish that you will accomplish it in due course. Of course in politics, where there are divisions of opinions as to solutions to the various problems, there will follow debate as to what steps need to be taken to solve the issues. So I repeat my opening best wishes for your endeavors to achieve the well-being of this community. To this end, I would like to conclude with a paraphrase of the advise given by Polonius to his son Laertes in Shakespeare's Hamlet: 'Listen to each mans opinion, but reserve thy judgement...this above all, to thy known self be true, and it must follow as the night the day, thou canst not then be false to any man.'

Thank you for listening and for the honor of allowing me to give this invocation. Harry, may you rest in peace."

Rep. Kolb, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

Sometimes a voice must be given to those whose voice seems to be ignored when they express their concerns. My 'no' vote on House Bill No. 5091 was one such vote, giving voice to the concerns expressed on this legislation. There are legitimate concerns in passing a law allowing state agencies and local units of government to place the motto 'In God We Trust' in public buildings. There is a concern that we as a State are on a slippery slope on the U.S. Constitutional protection of separation of church and state. Civil and legal rights advocates, and religious groups have voiced their concerns and opposition to HB 5091. Beyond the issue of separation of church and state, there are concerns that this phase alienates those in our communities whose religion worships more than one god or those persons who do not worship a god at all. My 'no' vote is to recognize these members of our communities and state, and the real danger of sliding down the slippery slope removing the protection of separation of church and state."

 

Rep. Bogardus, having reserved the right to explain her protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on HB 5091 because I believe it is unconstitutional in that putting the words in God we trust indicates state support of a specific group of religions. We are a diverse country our constitution is based on religious freedom this clearly undermines that freedom in that tax dollars will be used to promote religions which specifically refer to God by that name."

Rep. Kolb, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on House Bill No. 4759, a bill to create a 'Choose Life' license plate with the funds going to 'crisis pregnancy' centers, because this legislation is blatantly unconstitutional. The 'Choose Life' logo is a recognized slogan of narrow interests in the 'anti-abortion' movement. It does not belong on a state license plate. If a citizen wants this slogan on their car, there is already a place for it. That place is the car bumper and if a person wants that slogan on their car they can use a bumper sticker to do that, not a state-sanctioned license plate. In Louisiana, where similar legislation was passed, a federal judge issued a preliminary injunction calling the 'Choose Life' plates 'very likely an unconstitutional restraint of free speech as it restricts the forum to only one view-that being the view of the State.' This legislation involves the State in collecting money to support only one side of a controversial and divisive political issue. Thus, the bill is tantamount to State sponsorship of a political message that is in conflict with our Constitutional rights as upheld by the U.S. Supreme Court. If this bill is signed into law it is certain to be challenged in court and will subject Michigan taxpayers to the expense of defending a law that is likely to be overturned."

 

Rep. Lemmons, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted against HB 4759 because it involves the State in collecting money to support only one side of a controversial and divisive political issue. Thus, the bill is tantamount to State sponsorship of a political message that is in conflict with our Constitutional rights as upheld by the U.S. Supreme Court. If the bill is signed into law it is certain to be challenged in court and will subject Michigan taxpayers to the expense of defending a law that is likely to be overturned."

 

Rep. Clarke, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted against HB 4759 because it would not fund agencies that offer a broad range of family planning services and counseling to women."

 

Rep. Drolet, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I yield to none in this body in my opposition to the practice of abortion, and to the legal sanction given to this reprehensible practice. A fetus is a human being and should be afforded legal protection as such, regardless of whether it is within or beyond its mother's womb. I have and will continue to cast votes that will move this society and its laws toward a greater recognition and respect for the human rights of ALL persons, and towards a more inclusive definition of what it means to be a human.

Though I share this cause with the supporters of this legislation, I believe that this particular bill will ultimately do a disservice to our common goals. The 'Choose Life Fund' sets a worrisome precedent. Today, we have the votes to establish a new license plate and a fund that endorses our respect and reverence for all human life, and we have a Governor who will sign it into law. Tomorrow, maybe a tomorrow not too far from now, the table may be turned on us. We could have a legislature and a Governor disposed toward a 'Pro Abortion Fund', complete with matching license plate. Those representatives will not need as much legislative support for their proposal, because they will come armed with the precedent that we give them today.

It grieves me to cast a vote against my compatriots in this noble cause. I believe that we have moved forward on many fronts, and look forward to future progress. Hopefully, my fears regarding this matter will never manifest themselves. But, if they do, I cannot in good conscience cast a vote today that will empower our opponents tomorrow."

A resolution honoring the life of Stanley R. Tyler, Jr.

Whereas, It is with deep sadness that we mourn the passing of Stanley R. Tyler, Jr., a dedicated community leader and caring person who was a great friend to the Greater Muskegon area. With genuine respect for his legacy, we join with the Greater Muskegon community and all of Michigan in extending our condolences to Mr. Tyler's family and many friends. He will be sincerely missed and long remembered; and

Whereas, After graduating from the first class of Muskegon Catholic Central High School in 1954 and receiving his business degree in 1958 from Notre Dame, Mr. Tyler returned to Muskegon to join the family business. Taking over as company president in 1970, Mr. Tyler owned and operated Muskegon's leading beer distributorship, Tyler Sales Inc., a company started by his father in 1934 and is still run today by his son, Jim; and

Whereas, The life of Stan Tyler is a study in the power of hard work, dedication, and commitment to his family, community, and business. A well-known figure in the Muskegon community, Stan Tyler supported community events to promote the Greater Muskegon area. Through many sponsorships, Tyler Sales helped begin and support such events as the Muskegon Summer Celebration, Parties in the Park, Muskegon Air Fair, and the Muskegon Shoreline Spectacular. Tyler Sales also supported the Whitehall Maritime Festival and the Bud Light "Spirit of America" National Offshore Run for Glory in the late 1980s; and

Whereas, Muskegon is losing not only a steadfast supporter, but also a friend. Stan Tyler's personal sense of dedication, integrity, and thoroughness have proven invaluable to the Muskegon area. Mr. Tyler was a founding member of the Muskegon Economic Growth Alliance and was President on the Board of Directors for the Miss Michigan Scholarship Pageant. He was also very involved in the Muskegon Notre Dame Club and the Michigan Beer & Wine Distributors; and

Whereas, Mr. Tyler's outstanding leadership has enriched lives throughout the entire community. With his wife Mary, the Tylers were founders of the successful Rainbow Auction and were also the founding members of the Muskegon County Catholic Central Foundation in 1960, an organization instrumental in establishing tuition assistance for needy children desiring a Catholic education; now, therefore, be it

A resolution honoring the life of Eugene "Gene" Alton Fisher.

Whereas, It is with deep sorrow that we join with the Muskegon Heights community and all of Michigan in mourning the loss of Eugene "Gene" Alton Fisher and to extend our condolences to Mr. Fisher's family and many friends. He will be sincerely missed; and

Whereas, Mr. Fisher began his career in the Print Shop of SD Warren in 1954. In 1966, after 11 years of working for SD Warren, he started working for Howmet Corporation. In 1971, Mr. Fisher was elected President of UAW Local 1243, where he negotiated numerous benefits for the employees until his retirement in 1993. His courage in defending his positions and his passion for his work and fellow workers benefited both his union members and the Howmet Corporation. Skilled in finding common ground, Mr. Fisher was instrumental in leading Howmet to reach agreement with its workforce, paving the way for several significant expansions; and

Whereas, In 1975, Mr. Fisher was elected to the Muskegon Heights City Council as Councilman and worked continually to serve the community in which he lived. He served as Mayor Pro Tempore for 20 years during the tenure of the late Mayor Robert Warren. Concurrently, Mr. Fisher served on the board of Community Mental Health of Muskegon County for 20 years. He was the Chairman of the Community Action Against Poverty for 3 terms and had served previously on the United Way board for the state of Michigan and Muskegon county; and

Whereas, In his 22 years of service to the people of Muskegon Heights, Mr. Fisher worked in the public arena during an era of great change. As he well knew, financial pressures and changing expectations made the past two decades a challenging time for Muskegon Heights. With the personal sense of duty that Mr. Fisher brought to the council, however, he was able to meet this challenge with enthusiasm and a genuine interest in serving the residents of Muskegon Heights. This has been deeply appreciated, both by citizens and organizations in Muskegon Heights that have benefited directly from Mr. Fisher's work, as well as, other public servants who have witnessed this fine example; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body join with the citizens of Muskegon Heights in honoring the life of Eugene "Gene" Alton Fisher. A resolution honoring Lee C. Bollinger, President of the University of Michigan, upon the occasion of his departure from the University of Michigan.

Whereas, Lee C. Bollinger is a graduate of the University of Oregon and Columbia Law School, where he was an Articles Editor of the Law Review. He served as a law clerk for Judge Wilfred Feinberg, United States Court of Appeals for the Second Circuit and Chief Justice Warren Burger, United States Supreme Court; and

Whereas, He is married to Jean Magnano Bollinger and has two children, Lee and Carey.

He joined the faculty of the University of Michigan in 1973, and was named Dean of the University of Michigan Law School in 1987, a position he held for seven years. He was named the twelfth President of the University of Michigan in November of 1996, after serving as Provost of Dartmouth College; and

Whereas, During his administration, the University of Michigan experienced a record number of applicants. It also had eighty-two percent of its undergraduate students graduating within six years, which is the highest graduation rate in the state of Michigan; and

Whereas, Under President Bollinger's leadership, the University of Michigan launched, in 1999, the Life Sciences Initiative as a campus wide effort to coordinate and expand research and teaching in such rapidly advancing fields as genomics, chemical and structural biology, cognitive neuroscience, and bioinformatics; and

Whereas, The University of Michigan has experienced a steady growth in fundraising during President Bollinger's administration. In three of the past four years, the University has raised more money from alumni than any other public university. Their research expenditures, more than $545 million in fiscal year 2000, are the highest among public universities in the United States; and

Whereas, President Bollinger has been an ardent and eloquent defender of affirmative action. He has been the motivating force behind what has become higher education's most comprehensive defense of affirmative action, marshaling considerable resources to defend the University's admissions policies and has garnered widespread support, both internally and externally; and

Whereas, President Bollinger worked to strengthen the experience of the arts on campus, complementing the efforts of the University Musical Society and the School of Music. The Walgreen Drama Center and the Arthur Miller Theatre are an outgrowth of that commitment. In addition, the Royal Shakespeare Company performed three cycles of Shakespeare's history plays in March of 2001 to enthusiastic audiences at the Power Center for the Performing Arts. Under President Bollinger's leadership and guidance, the University of Michigan also established the Gerald R. Ford School of Public Policy; and

Whereas, President Bollinger appointed the Commission on the Undergraduate Experience in May of 2000 to examine how undergraduates are engaged at the University of Michigan. He met regularly with students and, on at least two occasions, opened his home to students, the first time following a University of Michigan victory over Penn State in 1997 on the way to the Wolverines' national football championship. More recently, he and his wife, Jean, invited students to their home to give students support to bring a sense of normalcy to campus following the terrorist attacks; and

Whereas, In 2000, President Bollinger strengthened the International Institute by elevating its profile within the University and by supporting such events as the "Globalization's Intellectual Challenge" symposium featuring Czech President Václav Havel; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body honor Lee C. Bollinger, President of the University of Michigan, upon the occasion of his departure from the University of Michigan; and be it further
