"Dear Lord, our God, our Father, our everything, we are here today before we go to take care of the business of the state of Michigan to pause and to acknowledge that You are here and You are real and You are good. We acknowledge dear Lord God, that nothing could happen without You. We ask for Your blessings upon the world. We ask, God, that You would let there be peace in this world. Let there be equality and real brotherhood established throughout this world today. Lord God, we come to ask for a blessing upon these, our United States. We ask that You would bless our land, that You would bless our leaders and that You would help our leaders to govern with wisdom and true understanding. Let them be a true example of what love for one another is all about. God, we come to ask a blessing upon our awesome state of Michigan. We ask that You bless this state of Michigan so that it would be an example for all of the other states in the United States to look at, to follow, to set a course after. God, we ask that You bless our legislators on both sides of the aisles today. Help us to seek Your will and to do Your work as we make decisions and as You guide us in deliberating what is in the best interest of all of the people in the state of Michigan. We ask, God, that before they enter into their private caucuses they would pause and honor the sanctity of prayer within their own minds and within their own hearts. We ask, God, that You remind us that Your word says that we should acknowledge You in all of Your ways. We ask that You would guide us and You would bless us and You would direct our path to prosperity, to health, to peace and to abundance. God, I am asking today that You bless everyone within the sound of my voice, those who are here and those who are yet on their way. Touch their minds, touch their hearts, touch their homes and be a blessing unto one and all. This is my prayer in Christ Jesus' name. It is so now, it so forever. Amen. Amen. Amen."

Substitute for House Resolution No. 378

A resolution to request the opinion of the Michigan Supreme Court on the constitutionality of certain questions of law pertaining to provisions of 2002 PA 48.

Whereas, Article III, Section 8 of the Michigan Constitution of 1963 provides that either house of the legislature may request the opinion of the Supreme Court on important questions of law upon solemn occasions as to the constitutionality of legislation after it has been enacted but before its effective date; and

Whereas, On March 14, 2002, Enrolled Senate Bill No. 880, having been duly enacted by the Michigan Legislature, was signed by the Governor and became 2002 PA 48. This act becomes effective November 1, 2002; and

Whereas, The bill was supported by numerous parties, including the Michigan Municipal League, the Michigan Township Association, Ameritech, Michigan Cable Telecommunications Association, AT&T Broadband, the Education Alliance of Michigan, Association of Independent Colleges and Universities of Michigan, Michigan Manufacturers' Association, Small Business Association of Michigan, and others; and

Whereas, The general purpose of 2002 PA 48 is to encourage competition and the introduction of new broadband services throughout the state. This act contemplates streamlining the process for authorizing access to and use of public rights-of-way by telecommunications providers, and provides for a common public rights-of-way maintenance fee applicable to telecommunications providers; and

Whereas, Section 3(1) of 2002 PA 48 creates the Metropolitan Extension Telecommunications Rights-of-Way Oversight Authority, pursuant to Article VII, Section 27 of the Michigan Constitution of 1963 and any other applicable law. Section 3(3) of 2002 PA 48 provides that the Rights-of-Way Oversight Authority has the power to assess fees on telecommunications providers owning telecommunications facilities in public rights-of-way. Section 5(2) of 2002 PA 48 states that a telecommunications provider asserting rights under 1883 PA 129 is subject to the permit and fee requirements of 2002 PA 48; and

Whereas, Section 4(1) of 2002 PA 48 provides that a ...municipality in a metropolitan area shall not enact, maintain, or enforce an ordinance, local law, or other legal requirement applicable to telecommunication providers that is inconsistent with this act or that assesses fees or requires other consideration for access to or use of the public rights-of-way that are in addition to the fees required under this Act.

; and

Whereas, The resolution of questions relating to the constitutionality of 2002 PA 48 is important to its certain and orderly implementation; now, therefore, be it

Resolved by the House of Representatives, That, pursuant to Article III, Section 8 of the Michigan Constitution of 1963, we respectfully request the Michigan Supreme Court to issue an advisory opinion on the following questions:

1. Whether the Metropolitan Extension Telecommunications Rights-of-Way Oversight Authority may constitutionally require a permit, under Section 5 of 2002 PA 48, and assess an annual maintenance fee, under Section 8 of 2002 PA 48, on all telecommunications providers in Michigan, including those providers that assert pre-existing franchise rights under 1883 PA 129.

2. Whether the Metropolitan Extension Telecommunications Rights-of-Way Oversight Authority, as established and empowered under Section 3 of 2002 PA 48, is duly constituted as a metropolitan authority under Article VII, Section 27 of the Michigan Constitution of 1963.

3. Whether the creation of an authority under Article VII, Section 27 of the Michigan Constitution of 1963 possessing the powers and duties provided for in 2002 PA 48 is a constitutional exercise of the Legislature's powers consistent with Article VII, Section 29 of the Michigan Constitution of 1963.

4. Whether the annual maintenance fee required to be paid by telecommunications providers under the provisions of 2002 PA 48 to recover the costs and in consideration of the right to use public rights-of-way constitutes a valid fee that is not prohibited from being imposed without voter approval by Article IX, Section 31 of the Michigan Constitution of 1963.

The questions involved are of great importance and solemn concern to the people of the state of Michigan; and be it further

Resolved, That a copy of this resolution be transmitted to the Michigan Supreme Court.

Whereas, Children's Hospital of Michigan, the oldest and largest hospital caring for the children of Michigan, has an active productive cancer survivor population. This demonstrates that a cancer diagnosis is no longer an automatic death sentence; and

Whereas, In addition to Childhood Cancer Survivors' Day, communities all across America will be celebrating life on Sunday, June 2, 2002, as part of the world's largest cancer survivor event, the 15th annual National Cancer Survivor's Day; now, therefore, be it

A resolution commemorating April 28, 2002, as Workers' Memorial Day in Michigan.

Whereas, April 28, 2002, has been selected for an observance to remember the working men and women who have been killed or injured as a result of their work. For this occasion, it is most appropriate to remember their own outstanding contributions to their work, communities, and our state. As we remember those who made the ultimate sacrifice in their chosen professions, we offer our deepest sympathy to their families, friends, and co-workers; and

Whereas, The enactment of the Occupational Safety and Health Act has helped to reduce the number of deaths in the workplace. It is important to remember that more must be done to ensure that all Americans have a safe workplace. The fact remains that far too many workers will be killed or injured this year. These deaths and injuries not only take a heavy personal toll on the families and co-workers left behind, but it also has a heavy economic impact in lost wages and productivity. There are certainly many compelling reasons for all parties to come together to improve workers' safety; and

Whereas, On Labor Day, we celebrate the contributions of the working men and women of this great country. It is fitting that on Workers' Memorial Day we take time to remember those who lost their lives as a result of their occupation. It is important that we never forget their contributions. It is just as important that we never stop working to improve workplace safety. If, through our efforts, we prevent at least one worker's death, then we will have truly honored those who have died or were injured as a result of a workplace accident; now, therefore, be it

Whereas, We take great pleasure in honoring Dr. Robert Arbuckle in grateful recognition of his tenure as President of Lake Superior State University. Dr. and Mrs. Arbuckle's commitment to the community since 1992 is exemplary and they are most deserving of our praise and commendation; and

Whereas, Dr. Arbuckle oversaw the largest period of growth in Lake Superior State University history during his tenure. This period included the renovation and expansion of Shouldice Library, Crawford Hall of Science, Norris Center, Taffy Abel Arena, and the Walker Cisler Student and Conference Center. It also included the establishment and construction of the Student Activity Center and the planning for the future construction of the Fine Arts Center; and

Whereas, Bob and Lorraine Arbuckle have been extremely active in the Sault Ste. Marie community. Dr. Arbuckle is active with the Sault Ste. Marie Rotary Club. He served as past President of the Sault Club and past District Governor for the Sault Ste. Marie Rotary District. He is on the Sault Ste. Marie Chamber of Commerce Board of Directors and was a past member of the Michigan Chamber of Commerce as well as a past Chairperson for the Sault Ste. Marie United Way. Dr. Arbuckle also received the Soo Chamber of Commerce Business Person of the Year Award for 2001. Lorraine has been, and currently is, active with the War Memorial Hospital Auxiliary. She also served on the University Service Committee; and

Whereas, While Bob and Lorraine's leadership will be greatly missed at the University. They do plan to remain part-time residents of Sault Ste. Marie and will continue to contribute to the community. As they gather to mark this milestone in their lives, it is most appropriate to commend them for the manner in which their strong relationship has enhanced the lives of all those fortunate enough to know these two extraordinary people; and

Whereas, On April 26, 2002, the Heidrichs will celebrate the vows they spoke 50 years ago at Grosse Pointe Memorial Church in Grosse Pointe, Michigan. A reception with family and friends will be held at Forest Lake Country Club in Bloomfield, Michigan. Over the last 50 years, they have been renewing these vows every day, not by words alone but through their actions. This unity has helped them meet the challenges of life and the joys of this world. As the Heidrichs would quickly affirm, no marriage can reach the milestone of 50 years without constant devotion and renewal; and

Whereas, By making a focal point of their marriage raising their three sons, and now enjoying their six grandchildren, they have shown dedication to the lives of their family. Through Christina's work as a devoted wife and mother and Richard's business, Richard Tool and Die, their marriage has allowed them to reach out in countless ways to their community. Richard has served as president of the Detroit chapter of the N.T.M.A., president of Little League, and is a Master Angler. Christina has been active with the Sweet Adeline's, Women's Committee Cranbrook, Women of Bloomfield, Farmington Players, and as a hospital volunteer. A resolution honoring Boaz Cheboiywo.

Whereas, It is a genuine pleasure to extend special recognition to Boaz Cheboiywo for his accomplishments at Eastern Michigan University in Ypsilanti, Michigan, as a student-athlete. Boaz Cheboiywo is a native of Eldonet, Kenya. He is the first Eastern Michigan University national champion in any sport at the Division I level and the first national champion in cross-country; and

Whereas, Boaz Cheboiywo set five course records in five races in which he competed in during the 2001 season, including the Pre-National Invitational at Furman University in South Carolina on October 13, 2001. This outstanding athlete also won the NCAA Great Lakes Regional on November 10, 2001, with a course record time of 29:52, nearly 45 seconds ahead of his nearest competitor. He won the 2001 NCAA Men's Cross Country Championship on November 19, 2001, with a course record time of 28:47. This was seven seconds faster than the previous record for the 10 kilometer course; now, therefore, be it

A concurrent resolution to create a special joint committee on access to health care in Michigan.

Whereas, The state of Michigan has one million uninsured people; and

Whereas, The state of Michigan has 250,000 uninsured children; and

Whereas, The state of Michigan is facing a health care problem reaching the critical stage; and

Whereas, Racial, income, and ethnic disparities in access to care threaten communities across the state, particularly communities of color; and

Whereas, Health care costs continue to increase, jeopardizing the health security of working families and small business; and

Whereas, Dollars that could be spent on health care are being used for administrative costs instead of patient needs; and

Whereas, The current Michigan health care system too often puts the bottom line ahead of patient care and threatens safety net providers who treat the uninsured and poorly insured; and

Whereas, Any health care reform must ensure that health care providers and practitioners are able to provide patients with the quality care they need; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That there be created a special joint committee on access to health care in Michigan. The special joint committee shall be comprised of four members of the House of Representatives, with two appointed by the Speaker of the House of Representatives and two appointed by the House Minority Leader, and four members of the Senate, with two appointed by the Senate Majority Leader and two appointed by the Minority Leader. The special committee shall report on its findings and recommendations by October 15, 2002; and be it further

Resolved, That the special joint committee shall study the issue of health care access and make recommendations for legislation and other policies that provide that every person in Michigan, regardless of income, age, or employment

or health status, has access to health care. The special joint committee shall work toward the establishment of a system that

--is affordable to individuals and families, businesses, and taxpayers that removes financial barriers to needed care and is as cost efficient as possible, spending the maximum amount of dollars on direct patient care;

--provides comprehensive benefits, including benefits for mental health and long-term care services and promotes prevention and early intervention, including parity for mental health and other services;

--eliminates disparities in access to quality health care and addresses the needs of people with special health care needs and underserved populations in rural and urban areas;

--addresses the need to have adequate numbers of qualified health caregivers, practitioners, and providers to guarantee timely access to quality care, provide adequate and timely payments in order to guarantee access to providers to foster a strong network of health care facilities, including safety net providers; and

--ensures continuity of coverage and continuity of care, maximizes consumer choice of health care providers and practitioners, is easy for patients, providers and practitioners to use, and reduces paperwork.
