"Father God, in the name of Jesus I pray that You would direct the leaders of this nation in times of crisis. Grant them wisdom and understanding, and help them to respond quickly and effectively to each situation. May divinely directed decisions be on their lips, and may they do that which is right in Your sight. May they follow Your will to direct our nation in the paths of peace and safety. Unite all response agencies in an organized and harmonious fashion to bring quick and effective resolve to the demands of this crisis. Empower us as United States citizens to do our part, financially, physically, emotionally and spiritually to support all who have been affected by this tragedy. I pray that You encourage and strengthen our nation. Surround us with Your love and mercy. Bring peace and comfort to all those who are suffering as a result of this crisis. We also pray for our soldiers, sailors and airmen that they come home safe, and pay honor to those who have paid the ultimate sacrifice and to their families. In Jesus' name we pray, Amen."

A concurrent resolution to memorialize the Congress of the United States to enact legislation to provide for tariff rate quotas to deal with the importation of dry milk protein concentrates.

With the recommendation that the following substitute (H-1) be adopted and that the concurrent resolution then be adopted.

Substitute for House Concurrent Resolution No. 9.

A concurrent resolution to memorialize the Congress of the United States to enact legislation to provide for tariff rate quotas to deal with the importation of dry milk protein concentrates.

Whereas, The dairy industry has been significantly impacted in recent years by the rising use of dry milk protein concentrates (MPCs). The technology that makes possible the ultrafiltration process that separates proteins and the other components of milk was not fully developed when the General Agreement on Tariffs and Trade (GATT) was finalized in 1994. As a result, there are almost no restrictions on the importation of MPCs. This is causing serious damage to the domestic dairy industry; and

Whereas, According to the General Accounting Office report on dairy products, the volume of MPC imports grew from 805 metric tons in 1990 to 44,878 in 1999. The quotas set under GATT in 1994 are clearly not comprehensive enough for the forms in which some dairy products are imported today. Foreign exporters are known to blend dairy proteins for the purpose of circumventing existing tariff rate quotas; and

Whereas, In the 108th Congress, legislation has been introduced to establish tariff rate quotas for MPCs. With the enactment of legislation to close this loophole, American agriculture will be able to compete on a more equal basis. The overall benefits, to our national economy and the domestic dairy industry, will strengthen a vitally important industry and restore the stability of the marketplace; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we memorialize the Congress of the United States to enact legislation to provide for tariff rate quotas for dry milk protein concentrates that are equivalent to the import quotas currently in place on other dairy products; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

Substitute for House Concurrent Resolution No. 10.

A concurrent resolution to urge the United States Customs Service to work for greater enforcement of food safety standards by reconsidering the classification of dairy products, especially those containing milk protein concentrates.

Whereas, The domestic dairy industry is very concerned about the effect that imported dry milk protein concentrates (MPCs) are having. The increasing use of these key components in many dairy products and the fact that regulations have clearly lagged behind technology are serious threats to a key part of American agriculture; and

Whereas, Farm groups concerned about the negative trends in the dairy industry strongly believe the dairy protein blends are being incorrectly classified by the United States Customs Service. The improper classification has created a trade loophole that encourages importers to circumvent tariffs on certain dairy products. It also undermines food safety standards. A key impact of this situation is economic hardship for American agriculture; and

Whereas, Although the United States Customs Service earlier took a stand advocating the proper classification of products with MPCs to ensure that high-fat dairy protein products are not immune from tariff, the Customs Service has since reversed its position. This has led key dairy industry representatives to challenge the current classification system. The long-term vitality of the American dairy industry hangs in the balance; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we urge United States Customs Service to work for greater enforcement of food safety standards by reconsidering the classification of dairy products, especially those containing milk protein concentrates; and be it further

Resolved, That copies of this resolution be transmitted to the United States Customs Service and the United States Food and Drug Administration.

In accordance with Public Act 440 of 2000, the Department of Consumer and Industry Services and the Michigan Statewide Trauma Care Commission are pleased to present to you with the Commission's final report.

This report offers recommendations on issues involving oversight, administration, coordination, assessment, and evaluation of trauma care delivery. In considering further action on these recommendations due consideration should be given to the resources available to the State and communities for this purpose.

On behalf of the Commission, we thank you for the opportunity to share these recommendations for the improvement of trauma care delivery in the State of Michigan.

Second Reading of Bills

House Bill No. 4236, entitled

A bill to amend 1978 PA 368, entitled "Public health code," by amending sections 16131 and 16263 (MCL 333.16131 and 333.16263), as amended by 2001 PA 139, and by adding section 16344 and part 187.

Rep. Ehardt moved to amend the bill as follows:

1. Amend page 2, following line 12, by inserting:

"Sec. 16186. (1) An individual who is licensed to practice a health profession in another state or, until January 1, 2004, is licensed to practice a health profession in a province of Canada, who is registered in another state, or who holds a health profession specialty field license or specialty certification from another state and who applies for licensure, registration, specialty certification, or a health profession specialty field license in this state may be granted an appropriate license or registration or specialty certification or health profession specialty field license upon satisfying the board or task force to which the applicant applies as to all of the following:

(a) The applicant substantially meets the requirements of this article and rules promulgated under this article for licensure, registration, specialty certification, or a health profession specialty field license.

(b) Subject to subsection (3), the applicant is licensed, registered, specialty certified, or specialty licensed in another state or, until January 1, 2004, is licensed in a province in Canada that maintains standards substantially equivalent to those of this state.

(c) Subject to subsection (3), until January 1, 2004, if the applicant is licensed to practice a health profession in a province in Canada, the applicant completed the educational requirements in Canada or in the United States for licensure in Canada or in the United States.

(d) Until January 1, 2004, if the applicant is licensed to practice a health profession in a province in Canada, that the applicant will perform the professional services for which he or she bills in this state, and that any resulting request for third party reimbursement will originate from the applicant's place of employment in this state.

(2) Before granting a license, registration, specialty certification, or a health profession specialty field license to the applicant, the board or task force to which the applicant applies may require the applicant to appear personally before it for an interview to evaluate the applicant's relevant qualifications.

(3) For purposes of the 2002 amendatory act that added this subsection, an applicant who is licensed in a province in Canada who meets the requirements of subsection (1)(c) and takes and passes a national examination in this country that is approved by the appropriate Michigan licensing board, or who takes and passes a Canadian national examination approved by the appropriate Michigan licensing board, is considered to have met the requirements of subsection (1)(b). This subsection does not apply if the department, in consultation with the appropriate licensing board, promulgates a rule disallowing the use of this subsection for an applicant licensed in a province in Canada.

(4) If the department receives an application for registration under part 187 from an individual who is registered as a respiratory therapist in the country of Canada, the department shall consult the international reciprocity agreement executed by the national board for respiratory care and the Canadian society of respiratory therapists in effect on the effective date of the amendatory act that added this subsection.".

2. Amend page 5, following line 24, by inserting:

"(d)"Respiratory care services" means the provision of preventative services, diagnostic services, therapeutic services, and rehabilitative services under the written, verbal, or telecommunicated order of a physician to an individual with a disorder, disease, or abnormality of the cardiopulmonary system as diagnosed by a physician. Respiratory care services may be provided by an inpatient or outpatient service or department within a health facility, by a home care agency or durable medical equipment company, or by an educational program." and relettering the remaining subdivision.

3. Amend page 5, line 25, after "therapist" by inserting "and respiratory care practitioner".

4. Amend page 5, line 26, after "providing" by striking out "patient" and inserting "respiratory".

5. Amend page 5, line 27, by striking out "prescription" and inserting "written, verbal, or telecommunicated order".

6. Amend page 6, line 2, after "support" by striking out "and" and inserting a comma.

7. Amend page 6, line 2, after "resuscitation" by inserting a comma and "and delivery of cardiopulmonary medications,".

8. Amend page 7, following line 5, by inserting:

"(2)The department shall issue a registration as a respiratory therapist to an individual who had either of the credentials as a registered respiratory therapist or certified respiratory therapist, or their predecessor credentials, conferred by the national board for respiratory care, or its predecessor organization, on or before the effective date of this part, and who applies for registration as a respiratory therapist within 1 year after the effective date of this part." and renumbering the remaining subsection.

9. Amend page 7, line 10, after "a" by striking out "registered".

10. Amend page 7, line 22, after "company" by inserting "or home care agency".

Rep. Condino, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I have respectfully voted no on passage of this bill as in my opinion the bill is overbroad and increases the scope of practice of dental assistants. In a very difficult and unstable economy this bill could have the effect of increasing the costs associated with dental care, especially impacting the uninsured."

A resolution to memorialize the Congress of the United States to enact legislation that would remove the unfair advantages that Federal Prison Industries has in competition for business.

Whereas, In 1934, Federal Prison Industries (FPI) was created as a government corporation. This system operates more than 100 factories, utilizes more than 20,000 inmate workers, and compiles total sales of approximately $500 million annually from over 150 products; and

Whereas, While the role that FPI plays in promoting the development of marketable skills among inmates has clear merits, this operation enjoys unfair advantages over private sector manufacturers. Even beyond the obvious wages and benefits advantages inmate workers offer, other factors favor FPI. This is especially true through certain governmental procurement policies, including a "mandatory source" requirement that severely limits competition; and

Whereas, Michigan is harmed significantly by the advantages FPI has over private manufacturers, especially within the furniture industry. Thousands of Michigan workers have lost their jobs in recent years, and the favorable policies for FPI are major contributing factors in these job losses; and

Whereas, In the past, legislation has been considered in Congress to address directly the issue of the preferential treatment afforded FPI in bidding for government contracts. This unfair situation needs to be corrected to preserve jobs and to restore fairness in the marketplace; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to enact legislation that would remove the unfair advantages that Federal Prison Industries has in competition for business; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
