"Sometimes, O Graceful Creator, we think our world has forgotten about holiness, laws of goodness have been broken, Your name is used with disrespect, children don't honor their parents, and we worry that chaos is swallowing up our civilization. But then we remember the many good people we know, and the kindness that fills their hearts. We recall the gentleness of feelings expressed in certain poems and songs, and in the best books and movies. And yet, we know that the world is filled with crime, vileness and disregard. But even more, we know that there are many who greatly cherish Your name and Your presence, and we give thanks for them. Teach us to care about everything, and to spend our lives in pursuit of the goals and values that matter most to Your justice and mercy. Show us love in the smile of a friend, and tenderness in the regard of a little child. Help us to wonder at the beauty of a single flower, and the morning sunrise. Pour out Your blessings upon us as we gather as people elected to make prudent use of all the goodness that You have given us in this great and blessed land. In the name of the One who is justice, love and mercy. Amen."

 

 

Motions and Resolutions

 

 

The Speaker, on behalf of the entire membership of the House of Representatives, offered the following resolution:

House Resolution No. 97.

A resolution of tribute offered as a memorial for Peter Kok, former member of the House of Representatives.

Whereas, The members of this legislative body were saddened to learn of the passing of Peter Kok, a distinguished public servant, businessman, and family man who devoted his life to others in many ways. Among his many accomplishments, his commitment to state government will long be remembered as a model of integrity and effectiveness; and

Whereas, A native of Grand Rapids and a graduate of Calvin College, Peter Kok answered his country's call to arms during the dark days of World War II. His abiding sense of patriotism and his loyalty to those around him were evident in his distinguished military record. He flew as a bombardier on 67 missions over Italy and southern France, and his heroism was acknowledged in many decorations, including the Silver Star, the Distinguished Flying Cross, and the Purple Heart; and

Whereas, Upon his return to civilian life, Peter Kok directed his energies to real estate. Community involvement and his strong sense of responsibility led him to elective public service. In 1964, he was elected to the first of his seven consecutive terms as State Representative from Kent County. As a lawmaker, this principled gentleman was known for his advocacy for open housing laws and for his exceptional leadership on mental health issues. Even after his retirement from the Michigan Legislature in 1978, he was appointed by Governor Milliken to the Michigan Council on Aging. Clearly, Peter Kok's dedication to others provided a model of unselfish service that is worthy of emulation today; now, therefore, be it

Resolved by the House of Representatives, That we offer this expression of our highest tribute to honor the memory of Peter Kok, a member of this legislative body from 1965 to 1978; and be it further

Resolved, That copies of this resolution be transmitted to the Kok family as evidence of our sincere condolences.

A bill to amend 1972 PA 222, entitled "An act to provide for an official personal identification card; to provide for its form, issuance and use; to regulate the use and disclosure of information obtained from the card; to prescribe the powers and duties of the secretary of state; to prescribe fees; to prescribe certain penalties for violations; and to provide an appropriation for certain purposes," by amending section 2 (MCL 28.292), as amended by 2002 PA 553.

A bill to amend 1941 PA 122, entitled "An act to establish the revenue collection duties of the department of treasury; to prescribe its powers and duties as the revenue collection agency of the state; to prescribe certain powers and duties of the state treasurer; to regulate the importation, stamping, and disposition of certain tobacco products; to provide for the transfer of powers and duties now vested in certain other state boards, commissions, departments and offices; to prescribe certain duties of and require certain reports from the department of treasury; to provide procedures for the payment, administration, audit, assessment, levy of interests or penalties on, and appeals of taxes and tax liability; to prescribe its powers and duties if an agreement to act as agent for a city to administer, collect, and enforce the city income tax act on behalf of a city is entered into with any city; to provide an appropriation; to abolish the state board of tax administration; to prescribe penalties and provide remedies; and to declare the effect of this act," by amending section 3 (MCL 205.3), as amended by 2002 PA 657.

Reps. Accavitti, Meisner, Dennis, Adamini, Condino, Hopgood, Elkins, Byrum, Tobocman, Law, Murphy, Waters and Gillard, having reserved the right to explain their protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on House Bill 4776 because it would change the definition of a de novo hearing for certain hearings. The term 'de novo hearing,' is a legal term. It describes a type of hearing on review of a matter where the court holds a completely new hearing. The prior hearing's decision is suspended and the reviewing court treats the case as though it were a matter of first impression, giving no attention to the findings and judgment from the prior hearing.

HB 4776 invents a new definition of a de novo hearing that means the opposite of what is commonly understood as a de novo hearing. Instead of allowing a new hearing, the new definition requires the court to simply review the prior hearing. This is particularly unfair because the prior hearings in these cases are not regular judicial proceedings held before a judge, but are hearings before a Friend of the Court referee. As a result, the bill essentially limits the opportunity of the parties to have their case heard before a judge. This is unfair and I cannot support it."

A resolution congratulating President Gerald R. Ford on his 90th birthday.

Whereas, Gerald Rudolph Ford was born Leslie Lynch King on July 14, 1913, and three years later was renamed Gerald Rudolph Ford Jr. after his mother was remarried to Gerald R. Ford Sr.; and

Whereas, Jerry Ford graduated with honors from South High School in Grand Rapids in 1931, and continued his education at the University of Michigan. He played center for the Wolverine football team and was selected most valuable player by his teammates during his senior year; and

Whereas, He went on to receive a law degree from Yale University in 1941. During World War II, Ford served as operations officer while on the U.S.S. Monterey in the Pacific, finishing his term with the Navy as a lieutenant commander; and

Whereas, After World War II, Gerald R. Ford returned to practice law in Grand Rapids. Soon after his marriage to Elizabeth Warren in 1948, he successfully challenged the incumbent Republican U.S. Representative, and won the congressional seat, which he diligently served in for 25 years; and

Whereas, Through his reputation of honesty and integrity, he gained the support of his fellow party members and in 1965, was chosen to be House Minority Leader. Jerry Ford held this position until President Nixon named him vice president in 1973; and

Whereas, Gerald R. Ford was sworn in as President of the United States after the resignation of President Nixon in 1974. President Ford took on the very difficult task of leading this country after the Vietnam War and the Watergate scandal. During his term, he successfully calmed tensions between Israel and Egypt, as well as between the United States and Soviet Union; and

A resolution to encourage President Jimmy Carter and Habitat for Humanity, International, to select Michigan as the site for the 2005 Jimmy Carter Habitat for Humanity Work Project.

Whereas, The Jimmy Carter Work Project is a well-respected program that meets the immediate needs of disadvantaged individuals and families through the construction of affordable, quality housing. Planning for this project for the 2005 year indicates that as many as 250 to 300 homes will be built; and

Whereas, Habitat for Humanity Michigan and its numerous local Michigan affiliates, the Michigan State Housing Development Authority, and the Community Economic Development Association of Michigan are committed to the 2005 Jimmy Carter Work Project. These groups, as well as many other private and public organizations, are working to secure the resources and support that will make this project successful; and

Whereas, Michigan strongly supports the concept of public­private partnerships to address the housing needs of our people. Habitat for Humanity efforts in our state have reflected this support, as does the fact that every county in the state will soon have a Habitat affiliate. Clearly, this sense of commitment can make the 2005 Jimmy Carter Work Project among the most successful housing ventures anywhere in the country; now, therefore, be it

I voted no on SB 464. At a time when the state is struggling to repair its crumbling roads, this bill and the others in the Mackinac Bridge bill package would take more than $5 million away from repairing Michigan's roads and bridges. Further, the bills in this package would forgive a combined debt of over $65 million owed to the state in restricted funds that are used to fix our roads."

 

Rep. Hopgood, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on SB 464, HB 4627, and HB 4631. HB 4631 amends the Michigan Transportation Fund Act to require at least $5.25 million dollars be appropriated annually from the State Trunkline Fund to the Mackinac Bridge Authority. We have just previously voted on a bill to forgive the Authority's debt for the construction of the bridge itself without appropriate financial information available. I believe it is fiscally irresponsible in one action to forgive a debt and then authorize a subsidy of bridge tolls."

Reps. Farrah, Accavitti, Anderson, Condino, Hopgood and Murphy, having reserved the right to explain their protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on House Bill 4452 (H-1) as amended because I have strong concerns about unintended consequences of this bill. First, if a school district switches to a 4-day school week, many parents will need to find day care for their children for that extra day. Some parents cannot afford this; will their children be left to roam the streets or at home alone and unsupervised. Having longer school days may prove to be too much for students. Some argue that students can handle only so much information each day, and once they reach that saturation point, additional instruction is not effective. In the past, the goal was increasing the school year. Now, we are allowing schools to have fewer days with longer hours. In some ways this seems inconsistent. Additionally, at a time when unemployment is high and our economy is weak, will this bill mean a 20 percent pay-cut for school bus drivers, lunch workers, etc.? For these reasons, I voted no on House Bill 4452 (H-1) as amended."

 

Rep. Bieda, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on House Bill 4452, as I had previously voted no on Senate Bill 364, because I have strong concerns about the unintended consequences of this bill. Paramount among these concerns is that if a school district switches to a four-day week, many parents will need to find day care for their children for that extra day. Some parents cannot afford this; will their children be left to roam the streets? Or stay at home alone and unsupervised? Having longer school days may prove to be too much for students. Many educational experts and parents argue that children can only handle so much information each day, and once they reach that saturation point, additional instruction is not effective. Lastly, previous legislatures have expressed the goal of increasing the school year. Now, we are allowing schools to have fewer days with longer hours. This seems to be rather inconsistent. Because of these concerns, and concerns previously expressed when I voted no on Senate Bill 364, I voted no on House Bill 4452."
