LEAD SAFE HOUSING REGISTRY H.B. 5116 (H-1): FLOOR ANALYSIS

CONTENT
The bill would amend the Lead Abatement Act (Part 54A of the Public Health Code) to do the following:
-- Require the Department of Community Health (DCH) to establish and maintain a "Lead Safe Housing Registry".
-- Require the owner of rental target housing, or of a child-occupied facility, to register the property with the DCH if it had been abated of or had interim controls performed to control lead-based paint hazards.
-- Allow the owner of other rental housing or a child-occupied facility to register it for a fee prescribed by the DCH.
-- Require an owner who was required to register his or her property to give the DCH a copy of each report, document, or other information that must be filed with the Federal government under Federal law and regulations related to lead-based paint.
-- Require the DCH to publish the registry on its website and provide a copy upon request.
("Target housing" means housing constructed before 1978, subject to certain exceptions.)

FISCAL IMPACT
This bill would have a moderate, indeterminate fiscal impact upon the State. The Department of Community Health would incur costs creating and maintaining the Lead Safe Housing Registry, handling required documents submitted to the State by owners of registered structures, and disseminating information to property owners and the general public.
This cost would be somewhat diminished by revenue generated from a registration fee imposed by DCH on owners of nontarget housing seeking inclusion on the registry and a cost-based fee for those seeking a paper copy of the registry.
Fiscal year 2004-05 Department of Community Health appropriations (Public Act 349 of 2004) include two line items for lead abatement-related activities totaling $4,220,400.
