SUBSTITUTE FOR

HOUSE BILL NO. 5262

                                                                             A bill to amend 1931 PA 328, entitled                                             

"The Michigan penal code,"                                                  

(MCL 750.1 to 750.568) by adding section 161a.                              

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1   Sec. 161a.  If an individual is participating in the child                  

2   support amnesty program established under section 3b of the                 

3   office of child support act, 1971 PA 174, MCL 400.233b,                     

4   prosecution shall not be initiated under section 161, 165,                  

5   167(1)(a), or 167(2) during the amnesty period.  If prosecution             

6   has been initiated or, if the individual has been arrested on a             

7   criminal warrant or a bench warrant related to the individual's             

8   child support obligation, before the individual seeks to                    

9   participate in the child support amnesty program, the individual            

10  is not eligible to participate in the child support amnesty                 

11  program.  A payer who makes full payment of past due support                

1   during the amnesty period shall not be prosecuted for failing to            

2   pay support due before the start of the amnesty period.  This               

3   section does not apply after 6 months after the effective date of           

4   the amendatory act that added this section.

5       Enacting section 1.  This amendatory act does not take                      

6   effect unless House Bill No. 4654 of the 92nd Legislature is                

7   enacted into law.
