SUBSTITUTE FOR
HOUSE BILL NO. 4450
A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 803b (MCL 257.803b), as amended by 2003 PA
152.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 803b. (1) The secretary of state may issue 1
2 personalized vehicle registration plate which shall be used on
3 the passenger motor vehicle, pick-up truck, motorcycle, van,
4 motor home, hearse, bus, trailer coach, or trailer for which the
5 plate is issued instead of a standard plate. Personalized plates
6 shall bear letters and numbers as the secretary of state
7 prescribes. The secretary of state shall not issue a letter
8 combination which might carry a connotation offensive to good
9 taste and decency. The personalized plates shall be made of the
10 same material as standard plates. Personalized plates shall not
1 be a duplication of another registration plate.
2 (2) An application for a personalized registration plate
3 shall be submitted to the secretary of state pursuant to section
4 217. Application for an original personalized registration plate
5 shall be accompanied with payment of a service fee of $8.00 for
6 the first month and of $2.00 per month for each additional month
7 of the registration period in addition to the regular vehicle
8 registration fee. A second duplicate registration plate may be
9 obtained by requesting that option on the application and paying
10 an additional service fee of $5.00. The original and duplicate
11 service fees shall be deposited in the transportation
12 administration collection fund created in section 810b.
13 Application for the renewal of a personalized registration plate
14 shall be accompanied with payment of a service fee of $15.00 in
15 addition to the regular vehicle registration fee. The service
16 fee shall be credited to the Michigan transportation fund and
17 shall be allocated pursuant to section 10 of 1951 PA 51, MCL
18 247.660. The amount allocated to the state trunk line fund shall
19 be used by the state transportation department for litter pickup
20 and cleanup on state roads and rights of way.
21 (3) The expiration date for a personalized registration
22 plate shall be pursuant to section 226. Upon the issuance or
23 renewal of a personalized registration plate, the secretary of
24 state may issue a tab or tabs designating the month and year of
25 expiration. Upon the renewal of a personalized registration
26 plate, the secretary of state shall issue a new tab or tabs for
27 the rear plate designating the next expiration date of the
1 plate. Upon renewal, the secretary of state shall not issue the
2 owner a new exact duplicate of the expired plate unless the plate
3 is illegible and the owner pays the service fee and registration
4 fee for an original personalized registration plate.
5 (4) The sequence of letters or numbers or combination of
6 letters and numbers on a personalized plate shall not be given to
7 a different person in a subsequent year unless the person to whom
8 the plate was issued does not reapply before the expiration date
9 of the plate.
10 (5) An applicant who applies for a registration plate under
11 section 217d, 803e, 803f, 803j, 803k, 803l, 803n, or 803o is
12 eligible to request, and the secretary of state may issue, the
13 registration plate with a sequence of letters and numbers
14 otherwise authorized under this section.
15 (6) (5) The secretary of state may issue a temporary permit
16 to a person who has submitted an application and the proper fees
17 for a personalized plate if the applicant's vehicle registration
18 may expire prior to receipt of his or her personalized plate.
19 The temporary registration shall be valid for not more than 60
20 days after the date of issuance. The temporary permit shall be
21 issued without a fee.
22 Enacting section 1. This amendatory act takes effect
23 January 1, 2006.
