    SENATE SUBSTITUTE FOR

    HOUSE BILL NO. 5262

(As amended, December 8, 2004)                                              

                                                                             A bill to amend 1931 PA 328, entitled                                             

"The Michigan penal code,"                                                  

(MCL 750.1 to 750.568) by adding section 161a.                              

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1   Sec. 161a.  <<Prosecution shall not be initiated against an

2   individual under section 161, 165, 167(1)(a), or 167(2) for failure or

3   refusal to pay child support while the individual has amnesty for that

4   child support arrearage under section 3b of the office of child support

5   act, 1971 PA 174, MCL 400.233b.

7       Enacting section 1.  This amendatory act does not take                      

8   effect unless House Bill No. 4654 of the 92nd Legislature is                

9   enacted into law.                                                           

10      Enacting section 2.  This amendatory act takes effect June                  

11  1, 2005.
