17 (2) A fee shall not be required for the registration of
18 property approved under the land sales act, 1972 PA 286, MCL
19 565.801 to 565.835.
20 (3) The real estate education fund is established in the
21 state treasury and shall be administered by the department.
22 Fifteen dollars of each license fee received by the department
23 under subsection (1)(b) during that 3-year license cycle shall be
24 deposited with the state treasurer to the credit of the real
25 estate education fund. The department shall utilize the real
26 estate education fund only for the operation of departmental
27 programs related to education required of all licensees or
1 applicants for licensure under article 25 of the occupational
2 code, MCL 339.2501 to 339.2518. Any unexpended balance in the
3 real estate education fund at the end of a fiscal year shall
4 carry forward to the next fiscal year.
5 (4) The real estate enforcement fund is created in the state
6 treasury and shall be administered by the department. Beginning
7 the license cycle
after the effective date of the amendatory act
8 that added this
subsection October 1, 2003,
$15.00 of each
9 license fee received by the department under subsection (1)(b)
10 during that 3-year license cycle shall be deposited into the real
11 estate enforcement fund. The department shall utilize the real
12 estate enforcement fund only for the enforcement of article 25 of
13 the occupational code, MCL 339.2501 to 339.2518, regarding
14 unlicensed activity as further described in section 601(1) and
15 (2) and to reimburse the attorney general for expenses incurred
16 in conducting prosecutions of such unlicensed practice. Any
17 unexpended balance in the real estate enforcement fund at the end
18 of a fiscal year shall carry forward to the next fiscal year.
19 Sec. 38. (1) Fees for an individual licensed or seeking
20 licensure as a state licensed real estate appraiser, a certified
21 general real estate appraiser, a certified residential real
22 estate appraiser, or a limited real estate appraiser under
23 article 26 of the occupational code, MCL 339.2601 to 339.2637,

3 (2) The license fee includes a fee imposed by the federal
4 government under sections 1113 and 1114 of title XI of the
5 financial institutions reform, recovery, and enforcement act of
6 1989, Public Law 101-73, 12 U.S.C. 3331 to 3351, for certified
7 general real estate appraisers, certified residential real estate
8 appraisers, and state licensed real estate appraisers, which
9 shall not exceed $50.00 per licensee and which the department
10 shall collect and pay to the federal government pursuant to
11 section 2637 of the occupational code, MCL 339.2637.
12 (3) The real estate appraiser education fund is established
13 in the state treasury and shall be administered by the
14 department. Ten dollars of each fee received under subsection
15 (1)(c) shall be deposited with the state treasurer to the credit
16 of the real estate appraiser education fund. The department
17 shall utilize the real estate appraiser education fund only for
18 the operation of departmental programs related to the education
19 required of all licensees or applicants for licensure under
20 article 26 of the occupational code, MCL 339.2601 to 339.2637.
21 Any unexpended balance in the real estate appraiser education
22 fund at the end of a fiscal year shall carry forward to the next
23 fiscal year.
