HOUSE SUBSTITUTE FOR
SENATE BILL NO. 753
A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 5474a; and to
repeal acts and parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 5474a. (1) Within 30 days after the effective date of
2 this section, the governor shall establish a childhood lead
3 poisoning prevention and control commission within the department
4 of community health. The commission shall consist of the
5 following 9 voting members appointed by the governor with the
6 advice and consent of the senate:
7 (a) One member representing the department of community
8 health. The member appointed under this subdivision shall serve
9 as chairperson.
10 (b) One member representing the family independence agency.
1 (c) One member representing the department of environmental
2 quality.
3 (d) One member representing the Michigan state housing
4 development authority.
5 (e) One member representing "Get the Lead Out!". The member
6 appointed under this subdivision shall be from a county with a
7 population of more than 500,000 but not more than 700,000.
8 (f) One member representing a local health department located
9 in a county with a population of more than 170,000 but not more
10 than 200,000.
11 (g) One member representing certified lead-abatement
12 contractors.
13 (h) Two members representing the general public. One of the
14 members appointed under this subdivision shall be from a city
15 with a population of 750,000 or more and be a parent of a child
16 who has experienced lead poisoning or a child advocate who has
17 experience with lead poisoning in children. The second member
18 appointed under this subdivision shall represent property owners
19 and developers in this state.
20 (2) Members of the commission shall serve without
21 compensation but, subject to appropriations, may receive
22 reimbursement for their actual and necessary expenses while
23 attending meetings or performing other authorized official
24 business of the commission. If a vacancy occurs on the
25 commission, that vacancy shall be filled in the same manner as
26 the original appointment.
27 (3) The childhood lead poisoning prevention and control
1 commission shall conduct at least 2 public hearings to seek input
2 from the general public and all of the following groups or
3 individuals that have an interest in childhood lead poisoning
4 prevention and control:
5 (a) The Michigan association of osteopathic family
6 practitioners or its successor organization.
7 (b) The Michigan nurses association or its successor
8 organization.
9 (c) The Michigan association of nurse practitioners or its
10 successor organization.
11 (d) The Michigan association of health plans or its successor
12 organization.
13 (e) The Michigan association of local public health or its
14 successor organization.
15 (f) Blue cross blue shield of Michigan or its successor
16 organization.
17 (g) The Michigan health and hospital association or its
18 successor organization.
19 (h) The Michigan head start association or its successor
20 organization.
21 (i) The Michigan council for maternal and child health or its
22 successor organization.
23 (j) Michigan's children or its successor organization.
24 (k) Michigan league for human services or its successor
25 organization.
26 (l) Detroit public schools or its successor organization.
27 (m) The rental property owners association or its successor
1 organization.
2 (n) The Michigan association of general contractors or its
3 successor organization.
4 (o) The Michigan association of realtors or its successor
5 organization.
6 (p) The Michigan environmental council or its successor
7 organization.
8 (q) The Michigan adult blood lead epidemiology and
9 surveillance program or its successor organization.
10 (r) The Michigan state university extension program or its
11 successor organization.
12 (s) The Detroit lead partnership or its successor
13 organization.
14 (t) The Michigan lead safe partnership or its successor
15 organization.
16 (u) The Detroit mayor's lead task force or its successor
17 organization.
18 (v) United parents against lead or its successor
19 organization.
20 (w) The department of education or its successor
21 organization.
22 (x) The Michigan department of community health medical
23 services administration or its successor organization.
24 (y) The Michigan occupational safety and health
25 administration or its successor organization.
26 (z) The Michigan department of community health bureau of
27 laboratories or its successor organization.
1 (aa) An occupational and environmental medicine specialist.
2 (bb) Parents or patient advocates of children who have
3 experienced lead poisoning.
4 (cc) A local housing authority.
5 (dd) A community reinvestment officer.
6 (ee) The Michigan state medical society or its successor
7 organization.
8 (ff) The Michigan academy of family practice or its successor
9 organization.
10 (gg) Saint Mary's field neurosciences institute or its
11 successor organization.
12 (hh) The American academy of pediatrics or its successor
13 organization.
14 (ii) The arc Michigan organization or its successor
15 organization.
16 (jj) Any other interested organization or association
17 concerned with the prevention, treatment, and control of lead
18 poisoning that the department determines necessary.
19 (4) The first public hearing shall be held within 60 days
20 after the commission has been appointed under subsection (1).
21 The commission may hold additional public hearings as it
22 determines necessary or appropriate to carry out its duties under
23 this part.
24 (5) The commission shall conduct its business at a public
25 meeting held in compliance with the open meetings act, 1976
26 PA 267, MCL 15.261 to 15.275. The commission shall give public
27 notice of the time, date, and place of the meeting in the manner
1 required by the open meetings act, 1976 PA 267, MCL 15.261 to
2 15.275.
3 (6) The commission shall make available a writing prepared,
4 owned, used, in the possession of, or retained by the childhood
5 lead poisoning prevention and control commission to the public in
6 compliance with the freedom of information act, 1976 PA 442,
7 MCL 15.231 to 15.246.
8 (7) As used in this section, "commission" means the
9 commission created and appointed by the governor under subsection
10 (1).
11 (8) This section is repealed effective July 1, 2007.
12 Enacting section 1. This amendatory act does not take
13 effect unless House Bill No. 5118 of the 92nd Legislature is
14 enacted into law.
