SUBSTITUTE FOR
SENATE BILL NO. 286
A bill to make appropriations for the department of consumer and
industry services and certain other state purposes for the fiscal year
ending September 30, 2004; to provide for the expenditure of those
appropriations; to provide for the imposition of certain fees; to
provide for the disposition of fees and other income received by the
state agencies; to provide for reports to certain persons; and to
prescribe powers and duties of certain state departments and certain
state and local agencies and officers.

9 GENERAL SECTIONS
10 Sec. 201. Pursuant to section 30 of article IX of the state
11 constitution of 1963, total state spending from state resources under
12 part 1 for fiscal year 2003-2004 is $318,529,600.00 and state spending
13 from state resources to be paid to local units of government for
14 fiscal year 2003-2004 is $29,315,900.00. The itemized statement below
15 identifies appropriations from which spending to units of local
16 government will occur:

24 Sec. 202. The appropriations authorized under this act are
25 subject to the management and budget act, 1984 PA 431, MCL 18.1101 to
1 18.1594.
2 Sec. 203. As used in this appropriation act:
3 (a) "AFC" means adult foster care.
4 (b) "Department" means the department of consumer and industry
5 services.
6 (c) "DOE" means the United States department of energy.
7 (d) "DOE-OEERE" means the DOE office of energy efficiency and
8 renewable energy.
9 (e) "DOL" means the United States department of labor.
10 (f) "DOL-ETA" means the DOL employment and training administration.
11 (g) "DOT" means the United States department of transportation.
12 (h) "DOT-RSPA" means the DOT research and special programs
13 administration.
14 (i) "EEOC" means equal employment opportunity commission.
15 (j) "Fiscal agencies" means Michigan house fiscal agency and
16 Michigan senate fiscal agency.
17 (k) "FTE" means full-time equated.
18 (l) "HHS" means the United States department of health and human
19 services.
20 (m) "HUD" means the United States department of housing and urban
21 development.
22 (n) "IDG" means interdepartmental grant.
23 (o) "MES" means Michigan employment security.
24 (p) "Subcommittees" means all members of the subcommittees
25 of the house and senate appropriations committees with jurisdiction over
26 the
27 budget for the department.
1 Sec. 204. The department of civil service shall bill departments
2 and agencies at the end of the first fiscal quarter for the 1% charge
3 authorized by section 5 of article XI of the state constitution of
4 1963. Payments shall be made for the total amount of the billing by
5 the end of the second fiscal quarter.
6 Sec. 205. (1) A hiring freeze is imposed on the state classified
7 civil service. State departments and agencies are prohibited from
8 hiring any new full-time state classified civil service employees and
9 prohibited from filling any vacant state classified civil service
10 positions. This hiring freeze does not apply to internal transfers of
11 classified employees from 1 position to another within a department.
12 (2) The state budget director shall grant exceptions to this
13 hiring freeze when the state budget director believes that the hiring
14 freeze will result in rendering a state department or agency unable to
15 deliver basic services, cause a loss of revenue to the state, result
16 in the inability of the state to receive federal funds, or would
17 necessitate additional expenditures that exceed any savings from
18 maintaining a vacancy. The state budget director shall report
19 quarterly to the chairpersons of the senate and house of
20 representatives standing committees on appropriations the number of
21 exceptions to the hiring freeze approved during the previous month and
22 the reasons to justify the exception.
23 Sec. 207. At least 60 days before beginning any effort to
24 privatize, the department shall submit a complete project plan to the
25 subcommittees and the fiscal agencies. The plan shall include the
26 criteria under which the privatization initiative will be evaluated.
27 The evaluation shall be completed and submitted to the fiscal agencies
1 and to the subcommittees within 30 months.
2 Sec. 208. Unless otherwise specified, the department shall use
3 the Internet to fulfill the reporting requirements of this act. This
4 may include transmission of reports via electronic mail to the
5 recipients identified for each reporting requirement or it may include
6 placement of reports on the Internet or Intranet site.
7 Sec. 209. Funds appropriated in part 1 shall not be used for the
8 purchase of foreign goods or services, or both, if competitively
9 priced and of comparable quality American goods or services, or both,
10 are available. Preference should be given to goods or services or
11 both manufactured or provided by Michigan businesses if they are
12 competitively priced and of comparable value.
13 Sec. 210. The director of each department receiving
14 appropriations in part 1 is encouraged to take all reasonable steps to
15 ensure businesses in deprived and depressed communities compete for
16 and perform contracts to provide services or supplies, or both. Each
17 director will strongly encourage firms with which the department
18 contracts to subcontract with certified businesses in depressed and
19 deprived communities for services, supplies, or both.
20 Sec. 211. The department shall establish and maintain
21 affirmative action programs based on guidelines developed by the state
22 equal opportunity workforce planning council which was created by
23 Executive Order No. 1996-13 in order to receive general fund/general
24 purpose dollars.
25 Sec. 212. The departments and state agencies receiving
26 appropriations under this act shall receive and retain copies of all
27 reports funded from appropriations in part 1. These departments and
1 state agencies shall follow federal and state guidelines for
2 short-term and long-term retention of these reports and records.
3 Sec. 213. From the funds appropriated in part 1 for information
4 technology, the department shall pay user fees to the department of
5 information technology for technology-related services and projects.
6 Such user fees shall be subject to provisions of an interagency
7 agreement between the department and the department of information
8 technology.
9 Sec. 214. Amounts appropriated in part 1 for information
10 technology may be designated as work projects and carried forward to
11 support technology projects under the direction of the department of
12 information technology. Funds designated in this manner are not
13 available for expenditure until approved as work projects under
14 section 451a of the management and budget act, 1984 PA 431,
15 MCL 18.1451a.
16 DEPARTMENT OF CONSUMER AND INDUSTRY SERVICES
17 Sec. 301. The appropriation in part 1 for fire protection grants
18 from the liquor purchase revolving fund shall be appropriated to
19 cities, villages, and townships with state-owned facilities for fire
20 services, instead of taxes, in accordance with 1977 PA 289,
21 MCL 141.951 to 141.956.
22 Sec. 302. The funds collected by the office of financial and
23 insurance services in connection with a conservatorship pursuant to
24 section 32 of the mortgage brokers, lenders, and servicers licensing
25 act, 1987 PA 173, MCL 445.1682, shall be appropriated for all expenses
26 necessary to provide for the required services. Funds are available
1 for expenditure when they are received by the department of treasury
2 and shall not lapse to the general fund at the end of the fiscal
3 year.
4 Sec. 303. The funds collected by the department from
5 corporations being liquidated pursuant to the insurance code of 1956,
6 1956 PA 218, MCL 500.100 to 500.8302, shall be appropriated for all
7 expenses necessary to provide for the required services. Funds are
8 available for expenditure when they are received by the department of
9 treasury and shall not lapse to the general fund at the end of the
10 fiscal year.
11 Sec. 304. The department may make available to interested
12 entities otherwise unavailable customized listings of nonconfidential
13 information in its possession, such as names and addresses of
14 licensees, and charge for this information as follows: base fee for 1
15 to 1,000 records at the cost to the department; 1,001 to 10,000
16 records at 2.5 cents per record; and 10,001 or more records at .5
17 cents per record. The revenue received from this service may be used
18 to offset expenses of programs as appropriated in part 1. The balance
19 of this revenue collected and unexpended at the end of the fiscal year
20 shall revert to the appropriate restricted revenue account or fund or,
21 in absence of such an account or fund, to the general fund. The
22 department shall submit an annual report on or before December 1 of
23 each year to the state budget office and the subcommittees that states
24 the amount of revenue received from the sale of information.
25 Sec. 306. The Michigan state housing development authority shall
26 annually present a report to the state budget office and the
27 subcommittees on the status of the authority's housing production
1 goals under all financing programs established or administered by the
2 authority. The report shall give special attention to efforts to
3 raise affordable multifamily housing production goals.
4 Sec. 307. The department shall assess and collect fees in the
5 licensing and regulation of child care organizations as defined in
6 1973 PA 116, MCL 722.111 to 722.128, and adult foster care facilities
7 as defined in the adult foster care facility licensing act, 1979
8 PA 218, MCL 400.701 to 400.737. Fees collected by the department
9 shall be used exclusively for the purpose of licensing and regulating
10 child care organizations and adult foster care facilities.
11 Sec. 310. Money appropriated under this act for fire safety
12 programs shall not be expended unless, in accordance with section 2c
13 of the fire prevention code, 1941 PA 207, MCL 29.2c, inspection and
14 plan review fees will be charged according to the following schedule:

26 Sec. 311. The department shall furnish the clerk of the house,
27 the secretary of the senate, the state budget office, and all members
28 of the house and senate appropriations committees with a summary of
29 any evaluation reports and subsequent approvals or disapprovals of
1 juvenile residential facilities operated by the family independence
2 agency, as required by section 6 of 1973 PA 116, MCL 722.116. If no
3 evaluations are conducted during the fiscal year, the department shall
4 notify the fiscal agencies and all members of the appropriate
5 subcommittees of the house and senate appropriations committees.
6 Sec. 312. (1) From the amount appropriated in part 1 to health
7 systems administration, the department shall provide funding for not
8 less than 113 inspectors to annually survey and investigate the care
9 and services delivered in nursing homes, county medical care
10 facilities, and hospital long-term care units in accordance with
11 provisions in the public health code, 1978 PA 368, MCL 333.1101 to
12 333.25211, and federal Medicare and Medicaid certification standards.
13 (2) The department, in keeping with the severity of the
14 allegations, shall investigate complaints alleging poor care and
15 services occurring on nights or weekends in nursing homes, county
16 medical care facilities, and hospital long-term care units by
17 conducting on-site investigations on nights or weekends.
18 Sec. 314. Funds earned or authorized by the United States
19 department of labor in excess of the gross appropriation in part 1 for
20 the bureau of worker's and unemployment compensation from the United
21 States department of labor are appropriated and may be expended for
22 staffing and related expenses incurred in the operation of its
23 programs. These funds may be spent after the department notifies the
24 state budget office and the subcommittees of the purpose and amount of
25 each grant award.
26 Sec. 315. The department shall sell documents at a price not to
27 exceed the cost of production and distribution. Money received from
1 the sale of these documents shall revert to the department. The funds
2 are available for expenditure when they are received by the department
3 of treasury and may only be used for costs directly related to the
4 continued updating and distribution of the documents pursuant to this
5 section. This section applies only for the following documents:
6 (a) Corporation and securities division documents, reports, and
7 papers required or permitted by law pursuant to section 1060(5) of the
8 business corporation act, 1972 PA 284, MCL 450.2060.
9 (b) The subdivision control manual, the state boundary commission
10 operations manual, and other local government assistance manuals.
11 (c) The Michigan liquor control code of 1998, 1998 PA 58,
12 MCL 436.1101 to 436.2303.
13 (d) The mobile home commission act, 1987 PA 96, MCL 125.2301 to
14 125.2349; the business corporation act, 1972 PA 284, MCL 450.1101 to
15 450.2098; the nonprofit corporation act, 1982 PA 162, MCL 450.2101 to
16 450.3192; and the uniform securities act, 1964 PA 265, MCL 451.501 to
17 451.818.
18 (e) Labor law books.
19 (f) Worker's compensation health care services rules.
20 (g) Minimum design standards for health care facilities.
21 (h) Construction code manuals.
22 (i) Copies of transcripts from administrative law hearings.
23 Sec. 316. The department shall provide electronic notification
24 to the state budget office, the fiscal agencies, and the subcommittees
25 on April 30 and October 31 on the initial and follow-up surveys
26 conducted on all nursing homes in this state. The notification shall
27 contain the location of the Internet site where the report is posted.
1 The report shall include all of the following information:
2 (a) The number of surveys conducted.
3 (b) The number requiring follow-up surveys.
4 (c) The number referred to the Michigan public health institute
5 for remediation.
6 (d) The number of citations per home.
7 (e) The number of night and weekend complaints filed.
8 (f) The number of night and weekend responses to complaints
9 conducted by the department.
10 (g) The average length of time for the department to respond to a
11 complaint filed against a nursing home.
12 (h) The number and percentage of citations appealed.
13 (i) The number and percentage of citations overturned and/or
14 modified.
15 Sec. 317. The department, bureau of safety and regulation, shall
16 provide an annual report by February 1 of each year to the state
17 budget office, the fiscal agencies, and the subcommittees on the
18 number of individuals killed and the number of individuals injured on
19 the job within industries regulated by the bureau during the most
20 recent year for which data are available.
21 Sec. 318. The department shall report by November 1 to the state
22 budget office, the legislature, and the fiscal agencies the status of
23 the nursing home complaint investigation backlog.
24 Sec. 319. As a condition for receiving the general fund/general
25 purpose appropriations in part 1 for health systems administration,
26 the department shall provide assistance to any person making an oral
27 request for a nursing home investigation in putting his or her request
1 into writing, shall initiate investigations on all written nursing
2 home complaints filed with the department within 15 days of receipt of
3 the complaint, and shall provide a written response to the complainant
4 within 30 days of receipt of the written complaint.
5 Sec. 320. The bureau of worker's and unemployment compensation,
6 during its transition to the remote initial claims system, may operate
7 a sufficient number of unemployment agency offices, including
8 itinerant or satellite offices, within Michigan's Upper Peninsula to
9 ensure that the citizens of the Upper Peninsula can access these
10 offices without excessive travel or, in cases where unemployment
11 claims are filed or renewed by phone, without excessive long-distance
12 toll charges.
13 Sec. 321. The department shall continue to work with grantees
14 supported through the appropriation in part 1 for emergency medical
15 services grants and contracts to ensure that a sufficient number of
16 qualified emergency medical services personnel exist to serve rural
17 areas of the state.
18 Sec. 322. From the funds appropriated in part 1 for utility
19 consumer representation, the department shall produce and facilitate
20 the airing of public service announcements that inform utility
21 customers of the availability and purpose of these funds. The utility
22 consumer participation board shall report to the subcommittees, fiscal
23 agencies, and state budget office by September 30 on its efforts in
24 this area, including the amount of expenditures made for this
25 purpose.
26 Sec. 323. (1) The department in consultation with nursing home
27 provider groups, the department of community health, the state
1 long-term care ombudsman, and the federal health care finance
2 administration shall continue to work to clarify the following terms
3 as those terms are used in title XVIII and title XIX and applied by
4 the department to provide more consistent regulation of nursing homes
5 in Michigan:
6 (a) Immediate jeopardy.
7 (b) Harm.
8 (c) Potential harm.
9 (d) Avoidable.
10 (e) Unavoidable.
11 (2) The department shall semiannually provide for joint training
12 with nursing home surveyors and providers on at least 1 of the 10 most
13 frequently issued federal citations in this state during the past
14 calendar year. The department shall provide a mechanism to measure
15 the effect of the training and shall report to the legislature and the
16 state budget office on the effect of the training by January 15.
17 Sec. 324. The bureau of worker's and unemployment compensation
18 shall work collaboratively with the department of career development
19 to ensure each 1-stop center has the ability to assist individuals or
20 respond to inquiries regarding unemployment benefits and the remote
21 initial claims system.
22 Sec. 325. (1) The department shall post on the Internet the
23 executive summary of the latest inspection for each licensed nursing
24 home.
25 (2) The department shall work toward posting inspection summaries
26 for licensed day care centers on the Internet.
27 Sec. 327. When hiring any new nursing home inspectors funded
1 through appropriations in part 1, the department shall make every
2 effort to hire individuals with past experience in the long-term care
3 industry.
4 Sec. 329. The department shall work to promote the nursing
5 scholarship program funded from appropriations in part 1 to health
6 services. The department shall focus its promotional efforts on
7 recruiting undergraduate students into the nursing field in order to
8 address the current nursing shortage. The department shall also make
9 every effort to utilize scholarship funds in a manner which encourages
10 undergraduate students to enter the nursing field.
11 Sec. 330. (1) The bureau of worker's and unemployment
12 compensation shall include in the remote initial claims center (RICCS)
13 automated phone system a choice to speak with an employee of the
14 unemployment agency as an option. This option should be provided in
15 the system as early as possible as deemed appropriate in the system
16 design. The department shall monitor the system to ensure compliance
17 with these guidelines.
18 (2) The bureau of worker's and unemployment compensation should
19 continue to provide training opportunities to employees affected with
20 the implementation of the RICCS.
21 Sec. 331. Nursing facilities shall report in the quarterly staff
22 report to the department, the total patient care hours provided each
23 month, by state licensure and certification classification, and the
24 percentage of pool staff, by state licensure and certification
25 classification, used each month during the preceding quarter. The
26 department shall make available to the public, the quarterly staff
27 report compiled for all facilities including the total patient care
1 hours and the percentage of pool staff used, by classification.
2 Sec. 332. It is the intent of the legislature that the
3 department make every effort to hold administrative law hearings on
4 actions initiated by the department against regulated businesses or
5 against individuals in regulated occupations in locations that are
6 within 150 miles of the regulated business or of the office of the
7 individual in a regulated occupation. In addition, it is the intent
8 of the legislature that the department make every effort to hold
9 administrative law hearings on actions initiated by an individual
10 outside the department in locations within 150 miles of the home of
11 the individual bringing the action if that individual wishes to
12 testify at the hearing.
13 Sec. 335. The public service commission shall report by June 1
14 of each year to the subcommittees, the state budget office, and the
15 fiscal agencies on the distribution of funds appropriated in part 1
16 for the low-income/energy efficiency assistance program.
17 Sec. 336. The department shall provide the subcommittees, fiscal
18 agencies, and state budget director with a report on or before
19 December 1 outlining actual expenditures for the last completed fiscal
20 year for each division within the office of financial and insurance
21 services.
22 Sec. 337. The department shall work cooperatively with the
23 family independence agency and with representatives from the Michigan
24 federation of private child and family agencies to form a licensing
25 and contract compliance review team pilot to coordinate and conduct
26 joint reviews of 1 child placing agency and 1 child caring institution
27 between October 1 and February 1. The Michigan federation of private
1 child and family agencies will survey team participants and involved
2 agencies regarding the process and provide feedback to the
3 department. The department shall report during the annual budget
4 presentation to the subcommittees regarding pilot outcomes.
5 Sec. 340. The office of financial and insurance services shall
6 provide copies of the quarterly and annual financial filings of health
7 maintenance organizations to the senate and house fiscal agencies on a
8 timely basis.
9 Sec. 341. The report required under section 911 of the business
10 corporation act, 1972 PA 284, MCL 450.1911, shall be filed with the
11 administrator together with a $25.00 filing fee.
12 Sec. 342. A report required under section 911 of the nonprofit
13 corporation act, 1982 PA 162, MCL 450.2911, shall be filed with the
14 administrator together with a $20.00 filing fee.

21 (2) In addition to a fee required to file a document, the
22 administrator may charge a fee of $50.00 if the document is filed by
23 facsimile or other electronic transmission or the administrator is
24 requested to transmit a document by facsimile or other electronic
25 transmission.
26 (3) The fees prescribed in subsections (1) and (2), no part of
27 which shall be refunded, when collected shall be paid into the
1 treasury of the state and credited to the administrator to be used
2 solely by the department in carrying out those duties required by
3 law.
4 (4) A minimum charge of $1.00 for each certificate and 50 cents
5 per folio shall be paid to the administrator for certifying a part of
6 a file or record pertaining to a domestic or foreign limited liability
7 company if a fee is not set forth in subsection (1). The
8 administrator may furnish copies of documents, reports, and papers
9 required or permitted by law to be filed with the administrator and
10 shall charge for those copies pursuant to a schedule of fees that the
11 administrator shall adopt with the approval of the state
12 administrative board. The administrator shall retain the revenue
13 collected under this subsection to be used by the department to defray
14 the costs of its copying and certifying services.
15 (5) If a domestic or foreign limited liability company pays fees
16 or penalties by check and the check is dishonored, the fee is
17 considered unpaid and the filing of all related documents will be
18 rescinded.
19 (6) The administrator may accept a credit card, instead of cash or
20 check, as payment of a fee under this act. The administrator shall
21 determine which credit cards may be accepted for payment.
22 Sec. 344. Pursuant to section 202 of the uniform securities act,
23 1964 PA 265, MCL 451.602, every applicant for registration shall pay a
24 filing fee and every registrant shall pay an annual fee of $300.00 in
25 the case of a broker-dealer, $65.00 in the case of an agent, and
26 $200.00 in the case of an investment adviser. Every applicant filing
27 an application for registration of a successor pursuant to section
1 202(d) of the uniform securities act, 1964 PA 265, MCL 451.602, shall
2 pay a filing fee of $125.00 for the unexpired portion of the year. A
3 registered agent who has terminated his or her connection with a
4 broker-dealer shall pay a transfer fee of $20.00 when transferring his
5 or her connection to another broker-dealer.
6 Sec. 345. (1) The fees appropriated by this section shall be
7 used only to offset the cost of operating the department.

1 Sec. 346. (1) Fees authorized by this section shall be used only
2 to offset the costs of operating the department.
3 (2) Money appropriated under this act for health facility
4 regulation shall not be expended unless the department assesses annual
5 fees for health facility and agency licenses and assesses fees for
6 permits, surveys, and plan reviews in accordance with the following
7 fee schedule:

13 (3) A person shall pay, and the department shall accept, fees
14 established in this section in lieu of any equivalent licensure survey
15 or review fee established by the public health code, 1978 PA 368, MCL
16 333.1101 to 333.25211. Fees not addressed in this section shall be
17 assessed and collected as prescribed by law.
18 (4) If a hospital requests the department to conduct a
19 certification survey for purposes of title XVIII or title XIX, the
20 hospital shall pay a license fee surcharge of $23.00 per bed. As used
21 in this subsection, "title XVIII" and "title XIX" mean those terms as
22 defined in section 20155 of the public health code, 1978 PA 368, MCL
23 333.20155.
24 (5) The license renewal fees described in subsection (2) shall be
25 assessed annually regardless of the term of a license.
26 (6) Fees described in this section are payable to the department
27 at the time they are assessed. If an application is denied or if a
1 license or permit is revoked before its expiration date, the
2 department shall not refund fees paid to the department.
3 (7) The fee for an initial, provisional, or upgrade license or
4 temporary permit is the same as for a license. A license may be
5 issued at the expiration date of a temporary permit without an
6 additional fee for the balance of the period for which the fee was
7 paid if the requirements for licensure are met.
8 (8) The application fee for a waiver under section 21564 of the
9 public health code, 1978 PA 368, MCL 333.21564, is $200.00 plus $40.00
10 per hour for the professional services and travel expenses directly
11 related to processing the application. The travel expenses shall be
12 calculated in accordance with the state standardized travel
13 regulations of the department of management and budget in effect at
14 the time of the travel.
15 (9) If an application for renewal of an ambulance operation,
16 nontransport prehospital life support operation, or aircraft transport
17 operation license is received by the department after the expiration
18 date of the license, the applicant shall pay a late fee in the amount
19 of $300.00 in addition to the renewal fee. If an application for
20 renewal is not received by the department within 60 days after the
21 license expires, the department shall not issue a renewal license
22 unless the licensee completes the requirements for initial licensure
23 and pays the late fee.
24 (10) If an application for renewal of an ambulance or nontransport
25 prehospital life support vehicle or aircraft transport vehicle license
26 is received by the department after the expiration date of the
27 license, the applicant shall pay a late fee in the amount of $100.00
1 in addition to the renewal fee. If an application for renewal is not
2 received by the department within 60 days after the license expires,
3 the department shall not issue a renewal license unless the licensee
4 completes the requirements for initial licensure and pays the late
5 fee.
6 (11) The department shall give nursing home providers the
7 voluntary option of requesting an informal review of the
8 appropriateness of a citation by an independent agency with
9 qualifications to conduct informal deficiency dispute resolutions as
10 required by federal law. The department may enter a contract with a
11 qualified agency for these reviews and shall charge a fee to a
12 facility requesting an independent review sufficient to cover the
13 actual cost.
14 Sec. 347. Of the funds appropriated in part 1 for the fire
15 protection grants, $12,128,500.00 of this funding is contingent upon
16 statutory changes that would increase the deposit into the liquor
17 purchase revolving fund.
18 Sec. 348. It is the intent of the legislature that the next
19 vacancy on the worker's compensation board of magistrates be filled by
20 an individual that is a permanent resident in the Upper Peninsula.
