A bill to amend 1996 PA 193, entitled
"Michigan do-not-resuscitate procedure act,"
by amending section 2 (MCL 333.1052), as amended by 2000 PA 59.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2. As used in this act:
2 (a) "Attending physician" means the physician who has primary
3 responsibility for the treatment and care of a declarant.
4 (b) "Declarant" means a person who has executed a
5 do-not-resuscitate order or on whose behalf a do-not-resuscitate
6 order has been executed as provided in section 3 or 5.
7 (c) "Do-not-resuscitate order" means a document executed as
8 prescribed in section 3 or 5 directing that, in the event that a
9 patient suffers cessation of both spontaneous respiration and
10 circulation in a setting outside of a hospital, a nursing home,
11 or a mental health facility owned or operated by the department
1 of community health, resuscitation will not be initiated.
2 (d) "Do-not-resuscitate identification bracelet" or
3 "identification bracelet" means a wrist bracelet that meets the
4 requirements of section 7 and is worn by the declarant while a
5 do-not-resuscitate order is in effect.
6 (e) "Emergency medical technician" means that term as defined
7 in section 20904 of the public health code, MCL 333.20904.
8 (f) "Emergency medical technician specialist" means that term
9 as defined in section 20904 of the public health code, MCL
10 333.20904.
11 (g) "Hospital" means that term as defined in section 20106 of
12 the public health code, MCL 333.20106.
13 (h) "Medical first responder" means that term as defined in
14 section 20906 of the public health code, MCL 333.20906.
15 (i) "Nurse" means a licensed practical nurse or a registered
16 professional nurse as defined in section 17201 of the public
17 health code, MCL 333.17201.
18 (j) "Order" means a do-not-resuscitate order.
19 (k) "Organization" means a company, corporation, firm,
20 partnership, association, trust, or other business entity or a
21 governmental agency.
22 (l) "Paramedic" means that term as defined in section 20908
23 of the public health code, MCL 333.20908.
24 (m) "Physician" means an individual licensed to engage in the
25 practice of medicine or the practice of osteopathic medicine and
26 surgery pursuant to article 15 of the public health code, MCL
27 333.16101 to 333.18838.
1 (n) "Patient advocate" means an individual designated to make
2 medical treatment decisions for a patient under sections 5506 to
3 5512 5515 of the estates and protected individuals
code, 1998

5 (o) "Public health code" means 1978 PA 368, MCL 333.1101 to
6 333.25211.
7 (p) "Vital sign" means a pulse or evidence of respiration.
8 Enacting section 1. This amendatory act does not take
9 effect unless Senate Bill No. 1464 _
10 of the 92nd Legislature is enacted into
11 law.
