A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 2217.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2217. (1) The psychotropic drug use advisory council
2 is created in the department. The advisory council shall consist
3 of the following members:
4 (a) One representative of each of the following:
5 (i) The department of community health.
6 (ii) The department of consumer and industry services.
7 (iii) The department of education.
8 (b) A licensed physician.
9 (c) A licensed child psychologist.
10 (d) A licensed child psychiatrist.
11 (e) A state-certified special education teacher.
1 (f) A school principal.
2 (g) A school counselor.
3 (h) Two parents.
4 (2) The department shall appoint the advisory council
5 members.
6 (3) The advisory council shall investigate, compile a report,
7 and recommend policies pertaining to psychotropic drug use among
8 children, using the following information and issues as
9 guidelines:
10 (a) Relevant literature and current research, including
11 professional practice guidelines.
12 (b) Surveys, conducted by the advisory council, on the extent
13 of behavioral disorders and the policies and treatments used in
14 treating those disorders.
15 (c) Relationship between behavioral disorders and learning
16 disabilities.
17 (d) Similarities and differences between school district
18 policies that deal with the recommended or mandated use of
19 psychotropic drugs and their relationship to school attendance.
20 This review of policies shall include general school policies, as
21 well as special education policies.
22 (e) Pattern of psychotropic drug use among children over the
23 past 25 years.
24 (f) Psychotropic drug use among children by age, gender, and
25 school district.
26 (4) The advisory council shall submit the report required by
27 subsection (3) to the legislature before January 1, 2004.
