A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9948) by adding section 185.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 185. (1) The drug treatment court fund is created in
2 the state treasury. The money in the fund shall be used as
3 provided in this section.
4 (2) The state treasurer shall credit to the drug treatment
5 court fund deposits of proceeds from the collection of revenue
6 from court assessments and costs directed to the fund by law and
7 shall credit all income from investment credited to the fund by
8 the state treasurer. The state treasurer may invest money in the
9 fund in any manner authorized by law for the investment of state
10 money. However, an investment shall not interfere with any
11 apportionment, allocation, or payment of money as required by
1 this section. The unencumbered balance remaining in the fund at
2 the end of a fiscal year shall remain in the fund and shall not
3 revert to the general fund.
4 (3) The fund shall be administered by the state court
5 administrative office for the administration of, and awarding of
6 grants for, drug treatment court programs throughout the state.
7 (4) To be eligible for funding, a drug treatment court shall
8 meet both of the following conditions:
9 (a) The court shall be responsible for handling cases
10 involving nonviolent substance abuse offenders through
11 comprehensive supervision, testing, treatment services, and
12 immediate sanctions and incentives.
13 (b) The court shall use all available local and state
14 personnel involved in the disposition of cases, including, but
15 not limited to, parole and probation agents, prosecuting
16 attorneys, defense attorneys, and community corrections
17 providers.
18 (5) Money from the fund may be used in connection with other
19 state, federal, and local funding sources. The state court
20 administrative office shall be reimbursed annually from the drug
21 treatment court fund for all reasonable costs associated with the
22 administration of this section.
23 Enacting section 1. This amendatory act takes effect
24 October 1, 2003.
