A bill to provide for the manner of approval of certain
compacts made between this state and an Indian tribe; and to
prohibit the construction and operation of casinos by Indian
tribes on certain land in this state.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. As used in this act:
2 (a) "Gambling" means an activity prohibited under chapter
3 XLIV or LV of the Michigan penal code, 1931 PA 328, MCL 750.301
4 to 750.315a and 750.372 to 750.376a.
5 (b) "Indian tribe" means that term as defined in section 4 of
6 the Indian gaming regulatory act, Public Law 100-497, 25
7 U.S.C. 2703.
8 Sec. 2. A compact between this state and an Indian tribe
9 that includes a provision relating to gambling is void unless it
10 is enacted as legislation pursuant to article IV of the state
1 constitution of 1963.
2 Sec. 3. The governor shall not concur in a determination by
3 the secretary of the interior of the United States to allow
4 gambling to be conducted on lands acquired by the secretary of
5 the interior in trust for the benefit of an Indian tribe after
6 October 17, 1988 as provided by section 20 of the Indian gaming
7 regulatory act, Public Law 100-497, 25 U.S.C. 2719.
