A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 61006.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 61006. Within 6 months after the effective date of the
2 amendatory act that added this section, the department shall
3 submit a report to the legislature that describes the actions
4 taken by the department to implement section 61005 and includes
5 at least all of the following:
6 (a) An inventory of both of the following:
7 (i) State lands within the Mason tract management area, the
8 Sand lakes quiet area, the Pigeon river country management area,
9 and the Jordan river valley management area, in which the federal
10 government owns subsurface oil and gas rights.
11 (ii) Federal lands in which the state owns subsurface oil and
1 gas rights.
2 (b) A recommended strategy for acquiring the federal
3 subsurface oil and gas rights on the state lands identified under
4 subdivision (a)(i).
5 (c) An analysis of the prospects for exchanging severed oil
6 and gas rights with the federal government that includes
7 identifying the key potential barriers to executing such
8 exchanges.
9 (d) A cost estimate for a valuation analysis that would allow
10 the department to gauge the value of the subsurface oil and gas
11 rights on federal lands held by the state so as to facilitate
12 potential exchanges.
13 Enacting section 1. This amendatory act does not take
14 effect unless Senate Bill No. _____ or House Bill No. 5651
15 (request no. 04690'03) of the 92nd Legislature is enacted into
16 law.
