A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
(MCL 257.1 to 257.923) by adding section 252h.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 252h. (1) An owner of private property that is open to
2 the public for business purposes, or his or her agent, shall not
3 tow or cause a vehicle to be towed from that property during
4 normal business hours unless the owner or agent of that property
5 has placed a sign on the property that is visible and legible
6 from the location on which the vehicle to be towed is located
7 stating that vehicles on that property are subject to being
8 towed. A sign substantially stating either of the following
9 meets the requirements of this section:
10 (a) Private property; unauthorized vehicles will be towed.
11 (b) Parking for customers only.
1 (2) This section does not apply to a vehicle towed in
2 compliance with sections 252a to 252g.
3 (3) An owner of private property, or his or her agent, who
4 tows or causes a vehicle to be towed in violation of this section
5 is liable to the owner of the vehicle for the actual costs of
6 towing and storing the vehicle, including any fees or penalties
7 arising out of that towing or storage.
