                                                                                 A bill to amend 1935 PA 220, entitled                                             

                                                                                

    "An act to provide family home care for children committed to the           

    care of the state, to create the Michigan children's institute              

    under the control of the Michigan social welfare commission, to             

    prescribe the powers and duties thereof, and to provide penalties           

    for violations of certain provisions of this act,"                          

                                                                                

    by amending section 2 (MCL 400.202) and by adding section 1a.               

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 1a.  The Michigan children's institute is transferred                  

                                                                                

2   from the family independence agency as an autonomous entity to              

                                                                                

3   the department of management and budget by type II transfer as              

                                                                                

4   defined in section 3 of the executive organization act of 1965,             

                                                                                

5   1965 PA 380, MCL 16.103.                                                    

                                                                                

6       Sec. 2.  The  said  Michigan children's institute shall be                  

                                                                                

7   under the control and management of the Michigan social welfare            

                                                                                

8   commission, hereinafter referred to as "the commission", whose              

                                                                                

9   appointment and duties are provided in Act No.  280 of the Public           

                                                                                


                                                                                

1   Acts of 1939, as amended, being sections 400.1 to 400.90,                   

                                                                                

2   inclusive, of the Compiled Laws of 1948, and as further expressly           

                                                                                

3   provided for in this act  an autonomous entity within the                   

                                                                                

4   department of management and budget.  The  commission  governor             

                                                                                

5   shall appoint the superintendent, and  such  other officers and             

                                                                                

6   employees as  it shall deem  necessary, who shall severally hold            

                                                                                

7   their offices and positions  during  at the pleasure of the                 

                                                                                

8   commission  governor.
