A bill to provide for the disposition of certain military
artifacts; and to require compliance with federal law.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. (1) The donee of demilitarized military equipment
2 or artifacts from a federal agency shall display the equipment or
3 artifacts in accordance with the agreement made with the donor
4 under the grant of conditional title.
5 (2) If a donee no longer wishes to keep the donated military
6 equipment or artifacts, the donee shall return the military
7 equipment or artifacts in a manner that complies with federal
8 law.
9 (3) If the donor of the military equipment or artifacts
10 described in subsection (2) cannot be ascertained, the military
11 equipment or artifacts shall be disposed of by complying with
12 section 7545 of title 10 of the United States Code, 10
1 U.S.C. 7545.
2 Sec. 2. As used in this act:
3 (a) "Donee" means a person or other entity that received
4 conditional title to demilitarized military equipment or
5 artifacts.
6 (b) "Donor" means an authorized agency of the United States
7 that granted conditional title to a donee.
8 (c) "Demilitarized" means deactivating military equipment or
9 artifacts so that the military function of the equipment or
10 artifact is permanently disabled.
