A bill to amend 1998 PA 58, entitled
"Michigan liquor control code of 1998,"
(MCL 436.1101 to 436.2303) by adding section 1029.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1029. (1) Beginning 12 months after the effective date
2 of the amendatory act that added this section, any licensee
3 selling any alcoholic liquor for consumption on the licensed
4 premises shall have available to the general public, on the
5 licensed premises and in proximity to the most utilized exit, a
6 self-operated device that provides a preliminary chemical breath
7 analysis. The device shall be a type approved by the
8 commission. This section does not obligate the licensee to
9 require a customer to use the device and does not require the
10 licensee to monitor the use of or collect any results of the
11 device.
1 (2) Not later than 6 months after the effective date of the
2 amendatory act that added this subsection, the commission shall
3 provide to any licensee, upon request, a list of approved
4 devices. The commission shall also make the list available to
5 the general public on its website.
6 (3) This section does not create any additional remedy
7 against a licensee for damage or injury to other persons or the
8 property of other persons.
9 (4) The commission may promulgate rules under the
10 administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to
11 24.328, to implement this section.
