A bill to amend 1980 PA 299, entitled
"Occupational code,"
by amending sections 401 and 403 (MCL 339.401 to 339.403),
section 401 as amended and section 403 as added by 1988 PA 463.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 401. (1)
The Until September
30, 2003, the specific
2 amounts to be charged for licenses, registrations, and other
3 activities provided for in this act shall be as prescribed in the
4 state license fee act, Act
No. 152 of the Public Acts of 1979,
5 being sections
338.2201 to 338.2277 of the Michigan Compiled
6 Laws 1979 PA 152, MCL 338.2201 to 338.2277.
7 (2) Beginning October 1, 2003, the amount of license and
8 registration fees to be paid to the department shall be
9 established by a fee schedule contained in an appropriation act
10 for that fiscal year.
1 Sec. 403. (1) This act does not prohibit a person who has a
2 contract with the department or any other person providing direct
3 services from collecting fees directly from an applicant,
4 registrant, or licensee.
5 (2) If the department terminates a contract with a person who
6 has been administering a licensing or registration examination to
7 applicants for licensure or registration in a specific
8 profession, and the department itself begins to administer the
9 examination, the department shall not charge an applicant a fee
10 greater than the fee charged under the terminated contract unless
11 the examination fee for
that profession is increased under the
12 state license fee act,
Act No. 152 of the Public Acts of 1979,
13 being sections
338.2201 to 338.2277 of the Michigan Compiled
14 Laws an appropriation act for the department for that
fiscal
15 year.
16 Enacting section 1. This amendatory act does not take
17 effect unless Senate Bill No. _____ or House Bill No. _____
18 (request no. 03206'03) of the 92nd Legislature is enacted into
19 law.
20 Enacting section 2. This amendatory act takes effect
21 October 1, 2003.
