A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 20950 (MCL 333.20950), as amended by 2000 PA
375.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 20950. (1) An individual shall not practice or
2 advertise to practice as a medical first responder, emergency
3 medical technician, emergency medical technician specialist,
4 paramedic, or emergency medical services instructor-coordinator
5 unless licensed to do so by the department.
6 (2) The department shall issue a license under this section
7 only to an individual who meets all of the following
8 requirements:
9 (a) Is 18 years of age or older.
10 (b) Has successfully completed the appropriate education
1 program approved under section 20912.
2 (c) Subject to subsection (3), has attained a passing score
3 on the appropriate department prescribed examination, as
4 follows:
5 (i) Within 3 years after the effective date of the
6 amendatory act that
added this subparagraph January 2, 2001,
a
7 medical first responder shall pass the written examination
8 proctored by the department or the department's designee and a
9 practical examination approved by the department. The practical
10 examination shall be administered by the instructors of the
11 medical first responder course. The department or the
12 department's designee may also proctor the practical
13 examination.
14 (ii) An emergency medical technician, emergency medical
15 technician specialist, and a paramedic shall pass the written
16 examination proctored by the department or the department's
17 designee and a practical examination proctored by the department
18 or the department's designee.
19 (iii) The fee for the written examinations required under
20 subparagraphs (i) and (ii) shall be paid directly to the national
21 registry of emergency medical technicians or other organization
22 approved by the department.
23 (d) Has submitted with his or her application a department
24 provided physical examination form that is completed and signed
25 by a physician or a certified nurse practitioner within the 12
26 months immediately preceding the date of the application.
27 (e) (d) Meets
other requirements of this part.
1 (3) Except as otherwise provided in subsection (2)(c)(i), not
2 more than 6 months after the
effective date of the amendatory
3 act that added this
subsection January 2, 2001, the
department
4 shall require for purposes of compliance with subsection (2)(c)
5 successful passage by each first-time applicant of an examination
6 as that term is defined in section 20904(10).
7 (4) The department shall issue a license as an emergency
8 medical services instructor-coordinator only to an individual who
9 meets the requirements of subsection (2) for an emergency medical
10 services instructor-coordinator and at the time of application is
11 currently licensed as an emergency medical technician, emergency
12 medical technician specialist, or paramedic and has at least 3
13 years' field experience as an emergency medical technician. The
14 department shall provide for the development and administration
15 of an examination for emergency medical services
16 instructor-coordinators.
17 (5) Except as provided by section 20952, a license under this
18 section is effective for 3 years from the date of issuance unless
19 revoked or suspended by the department.
20 (6) Except as otherwise provided in subsection (7), an
21 applicant for licensure under this section shall pay the
22 following triennial licensure fees:
23 (a) Medical first responder - no fee.
24 (b) Emergency medical technician - $40.00.
25 (c) Emergency medical technician specialist - $60.00.
26 (d) Paramedic - $80.00.
27 (e) Emergency medical services instructor-coordinator -
1 $100.00.
2 (7) If a life support agency certifies to the department that
3 an applicant for licensure under this section will act as a
4 volunteer and if the life support agency does not charge for its
5 services, the department shall not require the applicant to pay
6 the fee required under subsection (6). If the applicant ceases
7 to meet the definition of a volunteer under this part at any time
8 during the effective period of his or her license and is employed
9 as a licensee under this part, the applicant shall at that time
10 pay the fee required under subsection (6).
