A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9947) by adding section 2917a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2917a. The owner or lessee of a facility where a
2 motion picture is being exhibited, the licensor of the motion
3 picture being exhibited, or the authorized agent or employee of
4 the owner, lessee, or licensor who alerts a law enforcement
5 agency of an alleged violation of section 465a of the Michigan
6 penal code, 1931 PA 328, MCL 750.465a, and who takes measures,
7 while awaiting the arrival of law enforcement authorities, to
8 detain an individual who the owner, lessee, licensor, agent, or
9 employee has probable cause to believe committed the violation is
10 not liable in a civil action arising out of the measures taken
11 unless the plaintiff shows that 1 or both of the following
1 apply:
2 (a) The measures taken were unreasonable.
3 (b) The period of detention was unreasonably long.
4 Enacting section 1. This amendatory act takes effect 90
5 days after the date it is enacted.
6 Enacting section 2. This amendatory act does not take
7 effect unless House Bill No. 5347 of the 92nd Legislature is
8 enacted into law.
