THIS RESOLUTION IS OFFERED TO COMPLY WITH SECTION 603 of 2003 PA 193.
Rep. Shackleton offered the following concurrent resolution:
House Concurrent Resolution No. 62.
A concurrent resolution to authorize the Department of Corrections to exceed the spending limits established under section 603 of 2003 PA 193 for special maintenance, remodeling, and renovations from existing operational accounts for the fiscal year ending September 30, 2004.
Whereas, The Department of Corrections was authorized operating appropriations for the fiscal year ending September 30, 2004, totaling $1,705,772,500.00 in 2003 PA 154, as adjusted in Executive Order No. 2003-23 and 2003 PA 237; and
Whereas, The Department of Corrections has requested authorization to spend in excess of $600,000.00 from existing operational accounts for the purpose of expediting capital renovations at Huron Valley Correctional Facility and Huron Valley Center that will facilitate the relocation of inmate populations and allow for the subsequent closure of Western Wayne Correctional Facility; and
Whereas, The Department of Corrections has estimated that the total cost of these renovations is $3,000,000.00; and
Whereas, The Department of Corrections must commence these projects immediately in order to ensure renovations are completed by October 1, 2004, to accommodate the relocation of female inmates from Western Wayne Correctional Facility to the Huron Valley Center, and the corresponding transfer of prisoners under psychiatric care from the Huron Valley Center to Huron Valley Correctional Facility; and
Whereas, The Department of Corrections budget for the fiscal year ending September 30, 2005, is predicated on full-year savings from the aforementioned facility closure and consolidations; and
Whereas, Pursuant to section 603 of 2003 PA 193, state agencies may expend not more than $600,000.00 from their operating budgets for special maintenance, remodeling, additions, or other capital outlay purposes, unless specifically authorized by the Legislature; now therefore, be it
Resolved by the House (the Senate concurring), That the Michigan Legislature recognizes the need to exceed the spending limits established pursuant to section 603 of 2003 PA 193, and hereby authorizes the renovation projects at Huron Valley Correctional Facility and Huron Valley Center to commence immediately at a cost not to exceed $3,000,000.00, to be paid from existing operational accounts appropriated to the Department of Corrections for the fiscal year ending September 30, 2004; and be it further
Resolved, That a copy of this resolution be transmitted to the State Budget Director, the Director of the Department of Corrections, and the Director of the Department of Management and Budget.
