A joint resolution proposing an amendment to the state
constitution of 1963, by amending section 12 of article IV, to
provide that the state officers compensation commission's
determinations of certain salaries and expense allowances be
reduced in certain circumstances.
Resolved by the Senate and House of Representatives of the
state of Michigan, That the following amendment to the state
constitution of 1963, to provide that the state officers
compensation commission's determinations of certain salaries and
expense allowances be reduced in certain circumstances, is
proposed, agreed to, and submitted to the people of the state:
1 ARTICLE IV
2 Sec. 12. The state officers compensation commission is
3 created which subject to this section shall determine the
4 salaries and expense allowances of the members of the
1 legislature, the governor, the lieutenant governor, the attorney
2 general, the secretary of state, and the justices of the supreme
3 court. The commission shall consist of 7 members appointed by
4 the governor whose qualifications may be determined by law.
5 Subject to the legislature's ability to amend the commission's
6 determinations as provided in this section, the commission shall
7 determine the salaries and expense allowances of the members of
8 the legislature, the governor, the lieutenant governor, the
9 attorney general, the secretary of state, and the justices of the
10 supreme court which determinations shall be the salaries and
11 expense allowances only if the legislature by concurrent
12 resolution adopted by a majority of the members elected to and
13 serving in each house of the legislature approve them. The
14 senate and house of representatives shall alternate on which
15 house of the legislature shall originate the concurrent
16 resolution, with the senate originating the first concurrent
17 resolution.
18 The concurrent resolution may amend the salary and expense
19 determinations of the state officers compensation commission to
20 reduce the salary and expense determinations by the same
21 proportion for members of the legislature, the governor, the
22 lieutenant governor, the attorney general, the secretary of
23 state, and the justices of the supreme court. The legislature
24 shall not amend the salary and expense determinations to reduce
25 them to below the salary and expense level that members of the
26 legislature, the governor, the lieutenant governor, the attorney
27 general, the secretary of state, and the justices of the supreme
1 court receive on the date the salary and expense determinations
2 are made. If the salary and expense determinations are approved
3 or amended as provided in this section, the salary and expense
4 determinations shall become effective for the legislative session
5 immediately following the next general election. If the balance
6 of the countercyclical budget and economic stabilization fund
7 reaches below $250,000,000.00 in any calendar year, the salary
8 and expense allowances of the members of the legislature, the
9 governor, the lieutenant governor, the attorney general, the
10 secretary of state, and the justices of the supreme court
11 determined by the state officers compensation commission shall be
12 reduced by 10% for the immediately following calendar year. The
13 commission shall meet each 2 years for no more than 15 session
14 days. The legislature shall implement this section by law.
15 Resolved further, That the foregoing amendment shall be
16 submitted to the people of the state at the next general election
17 in the manner provided by law.
