Rep. Rick Shaffer, from the 59th District, offered the following invocation:
"Fear thou not; for I am with thee: be not dismayed; for I am thy God. I will strengthen thee; I will uphold thee with the right hand of My righteousness. For I, the Lord thy God, will hold thy right hand saying unto thee, 'Fear not for I will help thee.' Gracious God, You're the Creator of the universe, the Sustainer of life and our everlasting Father. Included in Your awesome prayer, awesome power, we are told that You have the ability of caring, as You call us by our names. And so this day, we give praise, honor and glory to You for Your goodness, greatness and everlasting mercy shown upon us. We as legislators do not take our responsibilities lightly as we analyze what is right by our own conscience, good for our constituents and beneficial to our great state of Michigan. We pray, therefore, as did Solomon of old, for wisdom and strength in our leadership roles. We pray for Your guidance as we deliberate on issues today. And so, dear Father, we claim the promise as shared from Your prophet and servant, Isaiah, that You will strengthen us, help us and even hold our hand as we walk with You. And all the people in the chamber said Amen."

Messages from the Senate
House Bill No. 4386, entitled
A bill to make appropriations for certain capital outlay programs and state departments and agencies for the fiscal year ending September 30, 2004; to implement the appropriations within the budgetary process; to make appropriations for planning and construction at state agencies; to make appropriations for state building authority rent and insurance; to make a grant for state building authority rent; to provide for the acquisition of land and buildings; to provide for the elimination of fire hazards; to provide for special maintenance, remodeling and addition, alteration, renovation, demolition, and other projects; to provide for elimination of occupational safety and health hazards; to provide for the award and implementation of contracts; to provide for the purchase of furnishings and equipment relative to occupancy of a project; to provide for the development of public recreation facilities; to provide for certain advances from the general fund; to prescribe powers and duties of certain state officers and agencies; to require certain reports, plans, and agreements; to provide for leases; to provide for transfers; to prescribe standards and conditions relating to the appropriations; to provide for the expenditure of appropriations; and to repeal acts and parts of acts.
The Senate has amended the bill as follows:
1. Amend page 18, following line 8, by inserting:
"Sec. 303. From the amounts appropriated in part 1, no money shall be used for the expansion of either the Scott correctional facility or the western Wayne correctional facility.".
The Senate has passed the bill as amended and ordered that it be given immediate effect.
The Speaker announced that pursuant to Rule 45, the bill was laid over one day.
Rep. Kooiman moved that Rule 45 be suspended.

House Resolution No. 153.
A resolution to memorialize the Congress of the United States to enact legislation to create a federal tax check-off program to fund grants to members of the National Guard and Reserves called to active duty for more than 60 days.
Whereas, The nature of the responsibilities of our fellow citizens serving in the National Guard and the Reserves has changed significantly. While reservists have always been well aware of the possibility of extended service in an active duty capacity, the evolving role of the American military in our troubled world has led to large-scale and lengthy mobilization of our reserve forces. Most experts feel that this trend will continue for the foreseeable future; and
Whereas, Thousands of members of the National Guard and Reserves are fulfilling difficult responsibilities in Iraq, Afghanistan, and elsewhere. The American people are aware of the extra sacrifices being made by these citizen soldiers and their beloved families. These enormous sacrifices include not only the obvious risk of life to protect our nation and its ideals, but also the serious financial hardships that face many families of deployed members of the National Guard and the Reserves; and
Whereas, The federal government and many state governments, including Michigan, utilize tax check-off programs on income tax forms to fund a variety of worthy programs. This concept should be developed with regard to the creation of funds to provide much-needed grants to the families of reservists serving extended stints on active duty; and
Whereas, The American people would likely be very supportive of a program that would allow taxpayers to designate from $1 to $5 ($2 to $10 for joint filers) to go to a fund within the United States Department of Treasury, with each state's contributions calculated. Based on the amount of money generated, grants could be provided to families of reservists of the respective states who are called to active duty for at least 60 days. These grants could be used to offset some of the financial hardships of paying rent and food bills. If the fund were allowed to roll over from year to year and build up, grants could also possibly be made one day to veterans hospitals or for other direct services to the individuals and families making sacrifices in the military; now, therefore, be it
Resolved by the House of Representatives, That we memorialize the Congress of the United States to enact legislation to create a federal tax check-off program to fund grants to members of the National Guard and Reserves called to active duty for more than 60 days; and be it further
Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

Substitute for House Resolution No. 116.
A resolution urging the Michigan Department of Education to continue to work to reach a suitable compromise with those school districts whose MEAP tests were recently lost.
Whereas, In 2001, Congress passed the No Child Left Behind Act (NCLBA) which, in part, requires states to implement statewide accountability systems covering all public schools and students. School districts and schools that fail to make adequate yearly progress toward statewide proficiency standards will be subject to mandatory improvement, corrective action, and restructuring measures. Parents of children attending schools that repeatedly fail to meet these standards may transfer their children to better performing public schools, including charter schools. The act also ensures that parents be provided with annual student performance report cards that show which schools in their communities are succeeding and which are not. This public information not only helps to enhance student achievement, but provides an incentive for failing schools to improve; and
Whereas, The NCLBA requires Michigan to report annually to the United States Secretary of Education on its progress toward implementing the law. This report includes information about student performance on the Michigan Educational Assessment Program (MEAP) and schools in need of improvement; and
Whereas, Michigan has had to postpone its determination of adequate yearly progress status of schools because the state contracted with a company that failed to live up to its obligations to make MEAP scores available on a timely basis. Although elementary and middle school students took the assessment test in January, the results were almost three months late. Moreover, the company lost more than 1,500 MEAP tests for school districts located in Grand Rapids and other communities. As a result, Michigan not only faces the likelihood of being penalized by the federal government for failing to meet reporting deadlines, but school districts with missing test results, albeit through no fault of their own, face the possibility of being classified as failing to meet adequate yearly progress as defined by the NCLBA; now, therefore, be it
Resolved by the House of Representatives, That we urge the Michigan Department of Education to continue to work to reach a suitable compromise with those school districts whose MEAP tests were recently lost; and be it further
Resolved, That a copy of this resolution be transmitted to the Michigan Department of Education.

Senate Concurrent Resolution No. 11.
A concurrent resolution to memorialize the Congress of the United States and the Environmental Protection Agency to repeal a certain regulation that provides for an exemption for ballast water discharges from permit requirements under the federal Clean Water Act.
Whereas, One of the most frustrating issues facing the Great Lakes is the threat from nonindigenous species. Invaders like the zebra mussel, the round goby, and the ruffe damage the ecology of the Great Lakes and connecting waterways in many ways. The impact of exotic species on municipal water systems, fishing, and aquatic plant life exacts a terrible toll on the nation's most important freshwater resource; and
Whereas, Michigan has exercised consistent leadership in the effort to prevent the arrival of more nonnative species. Our state has put incentives in place in an effort to curb the release of untreated ballast water from the ships that traverse the lakes, which is the primary source of these foreign species. As a state that has suffered significantly because of organisms released into the lakes through the discharge of ballast water, Michigan has repeatedly called for stronger steps to prevent this from happening; and
Whereas, The effort to halt the introduction and spread of nonindigenous species through ballast water discharges continues to be frustrated by federal regulations under the Clean Water Act. Although this key federal act requires permits through the National Pollution Discharge Elimination System for discharges, 40 C.F.R. § 122.3(a) provides that discharges from vessels that are incidental to normal operations are exempt from the permit requirement. Although efforts to repeal this exemption recently failed, removing the exemption remains a vitally important step to take to safeguard the Great Lakes; now, therefore, be it
Resolved by the Senate (the House of Representatives concurring), That we memorialize the Congress of the United States and the Environmental Protection Agency to repeal 40 C.F.R. § 122.3(a), which provides for an exemption for ballast water discharges from permit requirements under the federal Clean Water Act; and be it further
Resolved, That copies of this resolution be transmitted to the Environmental Protection Agency, the United States Coast Guard, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.)
