Second Reading of Bills
House Bill No. 5029, entitled
A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 40103 (MCL 324.40103), as amended by 2000 PA 191; and to repeal acts and parts of acts.
Was read a second time, and the question being on the adoption of the proposed substitute (H-1) previously recommended by the Committee on Conservation and Outdoor Recreation,
The substitute (H-1) was adopted, a majority of the members serving voting therefor.
Rep. Emmons moved to amend the bill as follows:
1. Amend page 3, line 26, after "Sec. 40110a" by inserting "(1)".
2. Amend page 4, following line 2, by inserting:
"(2) The department shall prepare a mourning dove brochure, post the brochure on its website, and distribute the brochure to the public through persons authorized to sell licenses under part 435. The brochure shall do at least the following:
(a) Provide information to help hunters distinguish mourning doves from other birds.
(b) Provide information regarding mourning dove management techniques for the propagation of the species.
(c) Describe how dove hunting is ethically, lawfully, and safely conducted.
(d) Provide information about the special opportunities mourning dove hunting offers to youth hunters, the elderly, and the disabled.
(3) $350,000.00 is hereby appropriated from the game and fish protection fund created in section 4355e for the preparation and distribution of the brochure.".

Rep. Spade moved to amend the bill as follows:
1. Amend page 4, following line 2, by inserting:
"Enacting section 1. This amendatory act does not take effect unless approved by a majority of the electors of this state voting on the question at the primary election to be held August 3, 2004. This amendatory act shall be submitted to the qualified electors of this state at that election as provided by the Michigan election law, 1954 PA 116, MCL 168.1 to 168.992. If approved by the electors, this amendatory act takes effect 10 days after the date of the official declaration of the vote.".

Rep. Tabor requested a ruling from the Chair regarding the germaneness of the amendment offered by Rep. Spade.
The Chair ruled that Article II, Section 9 of the Constitution of the State of Michigan of 1963, clearly states that "the power of initiative extends only to laws which the legislature may enact under the constitution. The power of initiative does not extend to acts making appropriations . . .". With the adoption of the amendments offered by Rep. Emmons, the Spade amendment is not properly before the House.
Rep. Spade moved to reconsider the vote by which the House adopted the amendments offered previously by Rep. Emmons.

Rep. Law, having reserved the right to explain her protest against the passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
I voted no on HB5029 because it undermines the public right to referendum and is fiscally irresponsible at a time when Michigan's budget is in crisis. Disallowing a citizen who clearly opposes dove hunting the right to vote on this issue is wrong and undermines the Democratic process."
Reps. Dennis, Zelenko, Murphy and Hopgood, having reserved the right to explain their protest against the passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
I voted no on the final passage of HB 5029 because of the amendment which was adopted that turned this bill into an appropriations bill. This amendment is clearly an effort to prevent the electors of this state from voting on an issue that would reverse a nearly century old policy that this state has to prevent the hunting of a song bird. This amendment sets a very bad precedent."
Rep. Richardville moved to suspend that portion of Rule 44 requiring bills to be handed to the Clerk three hours prior to calling the House to order.

A resolution to commemorate the week of November 1-8, 2003, as Michigan Festivals and Events Week.
Whereas, The Michigan Festivals and Events Association, the largest state event association in the nation with more than 750 members statewide, recognizes and is dedicated to supporting and promoting Michigan festivals, fairs, events, attractions and tourism; and
Whereas, Michigan festivals, fairs and events provide an opportunity for residents and visitors to celebrate the culture, history, agriculture and maritime heritage of the Great Lakes State year-round; and
Whereas, Such events bring hosting communities together through the planning of and attendance at these civic celebrations, providing opportunities for community volunteers to discover, develop and display their skills and talents; and
Whereas, Travel to communities and surrounding regions is stimulated by festivals, fairs, and events, generating community growth and prosperity from these tourism dollars, as well as broadening knowledge of the area's cultural and recreational resources; and
Whereas, Michigan festivals, fairs and cultural events annually attract more than 35 million attendees, many of whom are family groups, from around the globe who contribute nearly $1 billion each year to Michigan's economy; now, therefore, be it
Resolved by the House of Representatives, That the members of this legislative body commemorate November 1-8, 2003, as Michigan Festivals and Events Week, and encourage all citizens of and visitors to Michigan to support and celebrate with us the hundreds of community festivals, fairs and events; and be it further
Resolved, That we recognize and thank the thousands of dedicated and tireless staff and volunteers for the work that they do within their communities to bring these events to the public, enriching our lives and creating the spirit that is Michigan; and be it further
Resolved, That a copy of this resolution be provided to every municipality in the state of Michigan.

A resolution to urge the President of the United States and the Prime Minister of Canada to present a formal request to the International Joint Commission to examine the matter of invasive species within the Great Lakes basin.

Substitute for House Resolution No. 158.
A resolution to urge the President of the United States and the Prime Minister of Canada to present a formal request to the International Joint Commission to examine the matter of invasive species within the Great Lakes basin.
Whereas, The protection, conservation, and use of the aquatic ecosystem formed by the Great Lakes basin are responsibilities shared by the United States and Canada, the eight Great Lakes states, two Canadian provinces, and the many cities that dot the shoreline. As the only state or province located entirely within the basin, Michigan has unsurpassed interest in protecting the Great Lakes from the onslaught of invasive species; and
Whereas, The Boundary Waters Treaty of 1909 established the six-member International Joint Commission (IJC) and gave it numerous powers. Among these powers is the authority to engage in joint fact finding on matters concerning boundary waters, especially within the Great Lakes basin, the largest boundary water system shared by our two countries. The United States and Canada have taken further joint actions to restore and maintain the waters of the Great Lakes through the Great Lakes Water Quality Agreement of 1972 and its subsequent protocols and annexes. The agreement requires the IJC to provide assistance in this work; and
Whereas, The IJC is a science-based organization that works to address key problems facing the Great Lakes ecosystem. The IJC was specifically established to address such problems as the threat posed by invasive species; and
Whereas, Invasive species are a form of biological pollution that clearly threatens the integrity of the Great Lakes basin ecosystem. Non-native species constitute the number one threat to aquatic biodiversity. Well over 150 exotic species are now established in the Great Lakes, and new invaders are being discovered at a rate of one every eight months. The damage done to the region of the Great Lakes is staggering and includes serious harm done to both to the economy and the ecology; and
Whereas, Ballast water discharges are the primary source of invasive species introduced into the Great Lakes. The regulation of navigation and international commerce are the exclusive jurisdictions of the federal governments of the United States and Canada; and
Whereas, Many people and organizations in the Great Lakes basin have urged the governments of the United States and Canada to refer the matter of invasive species to the International Joint Commission for investigation and to recommend actions and coordinate policies to prevent further introductions of invasive species; now, therefore, be it
Resolved by the House of Representatives, That we urge the President of the United States and the Prime Minister of Canada to present a formal request to the International Joint Commission to examine the matter of invasive species within the Great Lakes basin. We urge that the request ask that the commission's study be comprehensive and include a reference to coordinate and harmonize binational efforts for action to stop this ongoing threat to the economy and the biological integrity of the Great Lakes regarding ballast water issues. We also call on the President of the United States and the Prime Minister of Canada to work to provide appropriate financial support for the International Joint Commission's efforts to deal with invasive species within the Great Lakes; and be it further
Resolved, That copies of this resolution be transmitted to the Office of the President of the United States, the Prime Minister of Canada, the United States Secretary of State, the Canadian Minister for Foreign Affairs, and the International Joint Commission.
The Speaker announced that under Rule 77 the resolution would lie over one day.

Substitute for House Concurrent Resolution No. 33.
A concurrent resolution to urge the President of the United States and the Prime Minister of Canada to present a formal request to the International Joint Commission to examine the matter of invasive species within the Great Lakes basin.
Whereas, The protection, conservation, and use of the aquatic ecosystem formed by the Great Lakes basin are responsibilities shared by the United States and Canada, the eight Great Lakes states, two Canadian provinces, and the many cities that dot the shoreline. As the only state or province located entirely within the basin, Michigan has unsurpassed interest in protecting the Great Lakes from the onslaught of invasive species; and
Whereas, The Boundary Waters Treaty of 1909 established the six-member International Joint Commission (IJC) and gave it numerous powers. Among these powers is the authority to engage in joint fact finding on matters concerning boundary waters, especially within the Great Lakes basin, the largest boundary water system shared by our two countries. The United States and Canada have taken further joint actions to restore and maintain the waters of the Great Lakes through the Great Lakes Water Quality Agreement of 1972 and its subsequent protocols and annexes. The agreement requires the IJC to provide assistance in this work; and
Whereas, The IJC is a science-based organization that works to address key problems facing the Great Lakes ecosystem. The IJC was specifically established to address such problems as the threat posed by invasive species; and
Whereas, Invasive species are a form of biological pollution that clearly threatens the integrity of the Great Lakes basin ecosystem. Non-native species constitute the number one threat to aquatic biodiversity. Well over 150 exotic species are now established in the Great Lakes, and new invaders are being discovered at a rate of one every eight months. The damage done to the region of the Great Lakes is staggering and includes serious harm done to both to the economy and the ecology; and
Whereas, Ballast water discharges are the primary source of invasive species introduced into the Great Lakes. The regulation of navigation and international commerce are the exclusive jurisdictions of the federal governments of the United States and Canada; and
Whereas, Many people and organizations in the Great Lakes basin have urged the governments of the United States and Canada to refer the matter of invasive species to the International Joint Commission for investigation and to recommend actions and coordinate policies to prevent further introductions of invasive species; now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), That we urge the President of the United States and the Prime Minister of Canada to present a formal request to the International Joint Commission to examine the matter of invasive species within the Great Lakes basin. We urge that the request ask that the commission's study be comprehensive and include a reference to coordinate and harmonize binational efforts for action to stop this ongoing threat to the economy and the biological integrity of the Great Lakes regarding ballast water issues. We also call on the President of the United States and the Prime Minister of Canada to work to provide appropriate financial support for the International Joint Commission's efforts to deal with invasive species within the Great Lakes; and be it further
Resolved, That copies of this resolution be transmitted to the Office of the President of the United States, the Prime Minister of Canada, the United States Secretary of State, the Canadian Minister for Foreign Affairs, and the International Joint Commission.

A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts," by amending section 20a (MCL 247.670a), as amended by 2002 PA 498.
