Senator Sikkema's statement is as follows:

I would recommend that we vote to confirm this individual. Teresa Takai has been appointed by the Govenor to be the Director of the Department of Information Technology.

This person comes to this position with an incredible amount of experience in this very area with some very large corporations, including the Federal Mogul Corporation, Electronic Data Systems, Ford Motor Company, and a variety of others. I think she certainly impressed this committee member with her knowledge of matters of information technology, her experience, and her ability to help this state through some difficult economic times. So I would very wholeheartedly recommend that we confirm this individual.

 

Senator Switalski's statement is as follows:

I rise today in support of the nomination of Teresa Takai, the next Director of the Department of Information Technology. Ms. Takai has over 30 years of management and technology experience in the private sector, most recently as director of Process Management with the Federal Mogul Corporation. Previous to her position with Federal Mogul, Ms. Takai held senior positions with Ford Motor Company and EDS. She has extensive information technology and management experience that makes her really an ideal candidate for this position.

The Department of Information Technology is a high priority for the new administration, and Ms. Takai can help streamline our systems and leverage our technology to better serve the citizens of Michigan. As part of her job, she is responsible for overseeing administration of the Michigan.gov Web portal which is utilized, as you know, by many citizens of Michigan every day. She will work to consolidate the management of information technology and resources in order to provide a more efficient and cost-effective system for the citizens of Michigan, businesses, and other state agencies. I hope that we will all join together and support her nomination.

 

 

The following message from the Governor was received on February 19, 2003, and read:

 

EXECUTIVE ORDER

No. 2003 - 3

 

Implementation of Expenditure Reductions Under Provisions of Article V,

Section 20, of the Michigan Constitution of 1963

 

Whereas, Article V, Section 20, of the Michigan Constitution of 1963 states that no appropriation is a mandate to spend, and that the Governor, with the approval of the appropriating committees of the House of Representatives and Senate, shall reduce expenditures authorized by appropriations whenever it appears that actual revenues for a fiscal period will fall below the revenue estimates on which appropriations for that period were based, and that reductions shall be made in accordance with procedures prescribed by law;

Whereas, it appears that actual revenues for the fiscal period from October 1, 2002 to September 30, 2003, will fall below the revenue estimates on which appropriations for that period were based, the estimates having been determined by the Legislature in accordance with Article IV, Section 31, of the Michigan Constitution of 1963;

Whereas, under provisions of Section 391 of the Management and Budget Act, 1984 PA 431, MCL 18.1391, on the basis of written information from the State Budget Director and the State Treasurer, it appears that actual revenue will fall below such revenue estimates;

Whereas, there is an unanticipated loss of funding which the departments and agencies of state government do not expect to obtain or make up during the current fiscal year;

Whereas, expenditure reductions totaling $125,481,146.00 general fund-general purpose and $19,804,400.00 special purpose funds are necessary;

Now, Therefore, I, Jennifer M. Granholm, Governor of the State of Michigan, pursuant to the authority vested in me by the Michigan Constitution of 1963 and the laws of the State of Michigan, and with the approval of a majority of members of each appropriations committee, do hereby order the following reductions:

A. Portions of general fund-general purpose appropriations amounting to $125,481,146.00 contained in the following public acts are hereby reduced. Where the expenditure reductions of general fund-general purpose appropriations in this order reduce the restricted portions of gross appropriations and sources of financing that will be earned, the amounts to be reduced shall be provided separately to the State Budget Director for approval and entry into the accounts.

After some time spent therein, the Committee arose; and, the President, Lieutenant Governor Cherry, having resumed the Chair, the Committee reported back to the Senate, favorably and without amendment, the following bill:

Senators Kuipers, Garcia, Van Woerkom, Brown, Birkholz, Sikkema, Sanborn, Cropsey, Hardiman, Cassis and Stamas offered the following concurrent resolution:

Senate Concurrent Resolution No. 9.

A concurrent resolution to oppose the approval of any new tribal-state gaming compacts.

Whereas, In spite of the existence of tribal gaming facilities in several areas of our state, the process of negotiating, approving, and implementing tribal-state gaming compacts remains embroiled in controversy. There are many legal questions that are still unanswered, including new questions involving land claims of a Michigan tribe; and

Whereas, Actions in the final hours of the Ninety-first Legislature with regard to a compact for the Gun Lake Band of Pottawatomi Indians in Allegan County did little but raise additional concerns. These concerns include determining the rights of local communities; and

Whereas, Neither the executive nor the legislative branches of the federal government has yet clearly defined how to resolve disputes between states and Indian tribes over gaming compacts; and

Whereas, The United States Supreme Court's decision in Seminole Tribe of Florida v Florida upheld the Eleventh Amendment and made unenforceable the right of tribal governments to bring suits against states in federal court for failure to negotiate in good faith; and

Whereas, Nothing exists in the federal Indian Gaming Regulatory Act of 1988 that bestows the Secretary of the Interior with the authority to allow tribal operation of Class III gaming and bypass the compact-development process established by law; and

Whereas, A key point in the litigation that has taken place to date is the question of how the legislature approves tribal-state gaming compacts. In November 2002, the Michigan Court of Appeals ruled on the question of whether approval can be by resolution instead of by bill. However, given the earlier Circuit Court ruling and given the significant differences between the requirements for a bill and a resolution, appeal on this crucial question seems likely; and

Whereas, Approval of any new gaming compacts would be premature until all pending litigation is resolved; and

Whereas, Apart from the formidable legal questions of authority involved, the issue of determining the location and operation of any major gaming facility ought to include the significant input and approval of the local area community; now, therefore, be it

Resolved by the Senate (the House of Representatives concurring), That we oppose the approval of any new tribal-state gaming compacts until all pending court cases have been decided; and be it further

Resolved, That copies of this resolution be transmitted to the Office of the Governor and the United States Secretary of the Interior.

Pending the order that, under rule 3.204, the concurrent resolution be referred to the Committee on Government Operations,

Senator Hammerstrom moved that the rule be suspended.

The motion prevailed, a majority of the members serving voting therefor.
