Rep. Bieda, having reserved the right to explain his protest against the passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
I voted 'no' on HB 4789 (H-2) because I'm concerned that the relatively low level of training required by this bill would put residents at risk. Critics cite research which suggests that anything less than 75 hours of training is insufficient preparation given the physical and mental status of many residents. The bill prohibits anyone less than 17 years old from serving as a dining assistant, yet I wonder if at the relatively youthful age of 17 or 18 a person has the maturity and experience to perform this function. While I appreciate the work the sponsor has done on this issue, and while I have been personally very active on nursing home reform issues, I am concerned that this bill does not adequately protect the best interests of the residents of our state's nursing homes. Thus, I voted no on this bill."
Reps. Byrnes, Cushingberry, Hopgood, Kathleen Law, Lemmons, Jr., Lemmons, III, Waters and Clack, having reserved the right to explain their protest against passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
I voted 'No' on House Bill 4789 because I am concerned about quality care in our nursing homes and the care our most vulnerable citizens receive. This bill would allow nursing homes to hire unskilled, barely trained individuals to feed nursing home residents. There have been no studies conducted that prove that these individuals, referred to as dining assistants, improve the quality of care for our most vulnerable residents. With the limited supervision required under this bill and the minimal 15.5 hours of training, this bill could put our seniors at-risk.
In addition, the Department of Community Health is currently working on a pilot program for dining assistants and having Michigan State University perform a comprehensive study on the effects of the program. This study will be the first of its kind in the nation. This report will evaluate the feasibility of dining assistants, the impact of dining assistants, whether positive or negative, on resident care, and whether the program should be altered of expanded statewide. This study should be completed and thoroughly reviewed prior to jumping into this program statewide."

House Concurrent Resolution No. 24.
A concurrent resolution urging the Congress and the President of the United States to increase the funding of the Low Income Home Energy Assistance Program.
Whereas, In light of the Hurricane Katrina disaster, many energy companies are raising their fees significantly, which will significantly impact low-income citizens of our country. The Michigan Public Service Commission expects natural gas prices to be higher than even preliminary estimates have suggested. Home heating bills are predicted to be nearly 50 percent higher than they were last year. This winter, when seasonal demand reaches its peak, costs are expected to strike a terrible blow to people who have had difficulties paying their home heating bills even before the recent increase in prices; and
Whereas, Low-income households in the United States may spend 15 to 20 percent of their earnings on home heating costs. High natural gas prices are squeezing the household budgets of families least able to adapt and most in need of reliable, affordable energy. This winter's situation is expected to bring a crisis to many people, including low-income seniors who will almost surely face difficult choices; and
Whereas, The federal Low Income Home Energy Assistance Program (LIHEAP) is one of the most critical components of the social safety net. Community action agencies and advocates for the vulnerable in society have called for increases to LIHEAP for the past several years, as appropriations levels have not kept up with rising heating costs, rising poverty, and an ever-increasing aging population. LIHEAP, which has taken its fair share of budget cuts and only serves one of five people who need its assistance, should have its funding increased to provide a safety net to help impoverished elderly and poor families meet their heating needs; now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), that we urge the Congress and the President of the United States to increase the funding of the Low Income Home Energy Assistance Program (LIHEAP); and be it further
Resolved, That copies of this resolution be transmitted to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
The concurrent resolution was referred to the Committee on Energy and Technology.
