Our Heavenly Father, as we gather here this morning, we give Thee thanks for this great nation that we have. We are thankful for our President and all of our national leaders. And, Father, this morning we are thankful for our Governor, the Lieutenant Governor, and all of these State Representatives and Senators who are here today. We ask, Lord, that You might bless them as they go about their business today. We pray that they might have wisdom from Thee, divine protection, and blessings now and in all that they do in the days to come.
You have taught us and by word that we should do justly, love mercy, and walk humbly with our God. Grant them, Father, wisdom to obey Thy will. We ask, Lord, Your blessings now in all that they do. We pray this in the name of Jesus Christ, our Lord and Savior. Amen.

A bill to amend 1967 (Ex Sess) PA 7, entitled "Urban cooperation act of 1967," by amending section 8a (MCL 124.508a), as amended by 1996 PA 45.

The following is the amendment to the substitute recommended by the Committee of the Whole:
1. Amend page 4, following line 9, by inserting:

A bill to amend 1939 PA 3, entitled "An act to provide for the regulation and control of public utilities and other services affected with a public interest within this state; to provide for alternative energy suppliers; to provide for licensing; to include municipally owned utilities and other providers of energy under certain provisions of this act; to create a public service commission and to prescribe and define its powers and duties; to abolish the Michigan public utilities commission and to confer the powers and duties vested by law on the public service commission; to provide for the continuance, transfer, and completion of certain matters and proceedings; to abolish automatic adjustment clauses; to prohibit certain rate increases without notice and hearing; to qualify residential energy conservation programs permitted under state law for certain federal exemption; to create a fund; to provide for a restructuring of the manner in which energy is provided in this state; to encourage the utilization of resource recovery facilities; to prohibit certain acts and practices of providers of energy; to allow for the securitization of stranded costs; to reduce rates; to provide for appeals; to provide appropriations; to declare the effect and purpose of this act; to prescribe remedies and penalties; and to repeal acts and parts of acts," (MCL 460.1 to 460.10cc) by adding section 10dd.

Senate Bill No.335, entitled
A bill to amend 1973 PA 116, entitled "An act to provide for the protection of children through the licensing and regulation of child care organizations; to provide for the establishment of standards of care for child care organizations; to prescribe powers and duties of certain departments of this state and adoption facilitators; to provide penalties; and to repeal acts and parts of acts," by amending section 1 (MCL 722.111), as amended by 2002 PA 696, and by adding section 17a.

House Bill No.4308, entitled
A bill to make, supplement, and adjust appropriations for various state departments and agencies for the fiscal year ending September 30, 2005; to provide for the expenditure of the appropriations; and to prescribe certain conditions for the appropriations.

Senator Patterson's statement is as follows:
I had a fascinating weekend this weekend, and I have read the competitiveness and premium excessiveness in the home and auto insurance industries in the state of Michigan report. I find it very interesting, and I commend it to the very thoughtful consideration of all members, especially the key findings appearing on pages 6-9, and the commissioner's findings which read in pertinent part at page 9, "Therefore, the rates charged by private insurance insurers in those markets, if challenged by the commission under Section 2114(2) could not be found to be excessive under current law, even if they were found to be unreasonably high." Very interesting.
I would also commend for people's consideration MIRS Capitol Capsule on Thursday, March 17, page 2 of 14, which quotes Curt Metzger, researcher from Wayne State, "The losses justify the premiums." And then Mike Miller, the actuary who oversaw the studies, "The primary drive for insurance rates in Michigan has been a steady persistent increase in the average cost of claims."
All very fascinating, especially when one considers the recommendations of the commissioner at point viii, which my readings suggest, we would abandon territorial rating and go to profiling.
Senator Scott's statement is as follows:
Let me just say it is good to be back, and I would like to thank each and every one of you for your well-wishes.

I understand that my absence was quite noticeable in that there was no one speaking out each day under Statements on the issue of insurance. However, I see today there was one speaking out. Well, I am back, and you can rest assured that during my convalescence, insurance reform was still very much on my mind and it continues to be my No.1 top priority.
I am very much aware of the recent findings produced by Wayne State University at the request of our commissioner in the Office of Financial and Insurance Services. I also agree wholeheartedly with the OFIS commissioner when she says, "Rates are unacceptably high and unaffordable for individuals with good records in several areas, especially our urban settings." She concluded that, "It is outrageous that we cannot take action to bring down rates in places like Detroit and Flint." And I would like to add Highland Park and Hamtramck since we are surrounded by Detroit.
The fact that the report shows that the insurance market is generally competitive does not translate into premium rates that are not excessive. Like I say, I'm back and you are going to hear this every day. As I said, you have heard me speak for months now on the issue of affordability. My constituents and many of your constituents simply cannot afford the high premium rates that they must pay in order to just comply with state laws and insure their vehicles.
I will remain optimistic that in the end, we will achieve meaningful insurance reform in the state of Michigan.
I would be remiss if I didn't acknowledge the fact that a dialogue has begun on the issue as a result of the information of an insurance workgroup, a dialogue that will hopefully lead us to an exchange of ideas to bring forth a plan of action and implementation of policies that will bring significant and much needed rate relief for the citizens of Michigan. As a matter of public policy, we cannot simply ignore the fact that significant rate disparities exist in this state, and I ask that you work with me to correct this inequity.
