A SUMMARY OF HOUSE BILL 4108 AS INTRODUCED 2-1-05

The bill would amend the Revised Judicature Act to exempt a person who stores anhydrous ammonia in a protected manner for agricultural purposes from liability for personal injury (including death) or property damage resulting from the theft of the anhydrous ammonia.

The phrase "in a protected manner" would mean either 1) in a tank that is properly equipped with a functioning tank or valve lock; or 2) with a substance added to the anhydrous ammonia containing a dye that will stain objects it comes in contact with, including skin and clothing, in a highly visible manner.
